We have been living in my mother in laws house for a few years taking care of her. She recently had a set back and now has to go into a nursing home. 15 years ago her and her husband signed the house over into a brothers name. My father in law died 10 years ago so it is only her on the lifetime resident papers. The brother in law wants nothing to do with the house and told me I could have it. The problem is there is a home equity of 8000 in the mother in laws name. We have been paying all the bills here including the home equity loan. How can I obtain possession of the property without paying a gift tax.

Taking possession is quite simple - have ur mother deed the property to u - but ur question is for accountant - maybe Willie can help u

I'm not a cpa but I believe doing a quitclaim deed to transfer property is subject to gift tax. I would talk to the lender about adding your name on title. That way when she passes you will be on living party on title. If you do that make sure to read up on title vesting. More than likely the lender will require a refince to add to title. You could take out a small cash out and close out the heloc.

Regarding title - have ur mother in law deed the house over to u now - I wouldn't notify the lender - all they can do is fuck with u for some dumb ass reason - just keep paying the mortgage and the lender will have no clue who the owner is and could care less

He really needs to consult an attorney. Gift taxes are steep. Might be able to just deed his name on title while leaving the mother in law on there. When she is deceased it wouldn't be considered a gift. Not 100% certain on that.
