Cellphone video taken moments after former New Orleans Saints star Will Smith was shot dead recorded an unidentified bystander saying the athlete was the first to claim to have a gun.
The witness doesn’t name the men exchanging angry words — but he seems to accuse Smith of being the aggressor before he was killed in the Lower Garden District at about 11:30 p.m. Saturday.
“This guy was like, ‘Get out of the f–king car, I have a gun,’ ” the witness said allegedly of Smith in footage posted Monday by the New Orleans Times-Picayune.
“And he [supposedly then referring to suspect Cardell Hayes] goes, ‘F–k y’all, I got one, too,’ and he [Hayes] grabs a gun and shoots him [Smith] in the back. He’s dead.”
Smith, 34, was shot in the back and side after a fender bender, according to a police warrant. Hayes, 28, has been booked on second-degree murder charges and held in lieu of $1 million bail.

Sounding more and more like former NFL player out for dinner and cocktails accidentally bumps into another vehicle. Not being a serious accident and not wanting to be implicated for a DUI proceeds to drive off. After being followed, he decides to confront the person following him in attempt to scare him off and not call police. Mistake = got caught threatening a thug.
Smith was just as guilty or merely just stupid for putting himself in that situation. Why not pull over when he bumped the guy? It's not like the Hummer came to a screaching halt. Rules of the road say you have to give yourself enough distance to properly stop in case the car in front of you stops suddenly. Gun or no gun, Smith made some poor decisions that cost him his life. Hayes is a thug and will go to prison. Hard to claim self defense when the victim is shot in the back.

Hayes called 911 as he followed Smith's car. Like it has been said a few previous posts back, bet Smith was hammered. There might have been an incident even before that restaurant video. If he thought he was going to shoot him, he wouldn't call 911 prior to doing it.

true but this is too weird if neither of them knew who was driving those cars. One of them had to of known. I think Hayes knew what Will Smith drove. Because why in the first place do you intentionally cause someone to hit you in the back? especially when you are in a hummer? The only reason would be to get into a situation. Will Smith driving away tells me he was trying to avoid the situation that he did not occur. Yeah he might of been driving drunk and his reactions were off but he didn't make any poor decisions from what I see besides driving drunk.

Yeah whenever you get hit in the back that is on the driver who rear ended you. Also video doesn't lie but we can interpret things differently. He barely touched his rear end ( no homo) and the hummer stops for no reason, no red light no stop sign. Just slams the breaks. You don't do that to any random person imo. It's not like a deer ran across the road in the streets of New Orleans. Hayes intended for that to happen. That's why he was so quick to pull off to the side of the road.

And being shot in the back on the side doesn't mean he was retreating. He might have been turning to his side to pull out a weapon, or pretending to pull out a weapon.
If someone hit and then ran on me, I would have done the same thing, followed and called the police. Even if he stopped short as a set up, cause he saw the guy driving too close drunk, in a nice car. He still should have pulled over. Maybe Hayes was running an insurance scam.

Lol if any of you are driving drunk and get into a little pussy ass accident like that that you felt wasn't caused by you, you would speed off like he did. The accident was caused by Hayes stopping for no reason on a one way street. There were no cars behind Smith at the time. Hayes knew what he was doing IMO.
They have a witness who said he heard Smith say he was going to get a gun.....And now a loaded gun was found in Smiths car.
