The Jets and former linebacker Erin Henderson were unable to come to terms on a private settlement, and now Henderson is suing the team for wrongful termination, according to ESPN.

Henderson filed his lawsuit Friday morning. The Jets declined to comment through a team spokesperson.

NJ.com first reported earlier this week that Henderson was planning to sue the Jets if the two sides couldn’t reach an agreement outside of court.

Henderson’s attorney sent a letter to owner Christopher Johnson on Sept. 14 stating he would file the lawsuit on Sept. 29 if no settlement was agreed upon.

Henderson is seeking $3.3 million in damages — the combination of a roster bonus, the remainder of his 2016 salary and his 2017 salary.
The Jets placed Henderson on the non-football injury list (NFI) in late October of last season. They then opted not to pick up his 2017 option in February.

Henderson claims he was unfairly placed on the NFI. The linebacker previously battled alcohol abuse before being cut by the Vikings in 2014. In the letter obtained by NJ.com, Henderson’s attorney says his client suffers from bi-polar disorder.
