Diminished Value Claim for Benz vs. Drunk Driver

Long story short... A buddy of mine bought a SL63 with a sticker of $160k and walked paying $145k. Has the car for 6-weeks and then get hit by a drunk driver at noon on a weekday. The broad is 2x the legal limit and gets 2nd DUI with property damage. She has Progressive insurance and they paid for the repair, but now he wants to file a Diminished Value Claim and because he is not the most savvy guy on the planet, he is asking for my help. Anyone ever done this before and have any advice?

I thought you take the loss on your taxes as a deduction not necessary a "get a check" claim. (I have no background whatsoever but for some reason I think I remember hearing that before)

Thanks. I have done some research and it is a legit thing here in Florida at least.
