Michael Avenatti has been hit with a second criminal probe referral amid reports that his client recanted her allegations against Supreme Court Justice Brett Kavanaugh.
Senate Judiciary Committee Chairman Chuck Grassley on Friday called for additional criminal charges to be brought against Avenatti one day after the senator filed an initial referral alleging that the attorney and his first client Julie Swetnick had intentionally misled lawmakers.
The Friday referral cites an NBC News report contending that a second unidentified accuser, who Avenatti claimed could corroborate Swetnick's claims, had 'disavowed key allegations and claimed Mr. Avenatti "twisted [her] words"'.
In a letter to US Attorney General Jeff Sessions and FBI Director Christopher Wray, Grassley wrote: 'In light of this new information, I am now referring Mr. Avenatti for investigation of additional potential violations ... stemming from a second declaration he submitted to the Committee that also appears to contain materially false statements.'

Senate Judiciary Committee Chairman Chuck Grassley filed the second Department of Justice referral on Friday, doubling down on allegations made in the initial referral Thursday alleging that Avenatti had intentionally misled lawmakers by 'twisting' a witness's words

Swetnick initially claimed that Kavanaugh attended a party where a train of men assaulted her. She claimed he was part of a group that surreptitiously spiked 'punch' at parties to 'cause girls to become inebriated and disoriented so they could then be gang raped' like she was.
She later walked back the claims, admitting that she cannot say for certain that Kavanaugh was part of, aware of or even witnessed the alleged sexual misconduct. She downgraded her claim about the punch bowl, as well. She says she saw him by the containers but doesn't know if he tampered with them.
Nearly two weeks after Kavanaugh's ultimate confirmation to the high court, Grassley this week threatened to bring criminal charges against Swetnick and Avenatti for wasting the committee's time with unsubstantiated allegations.

In Thursday's referral Grassley harped: 'When charlatans make false claims to the Committee – claims that may earn them short-term media exposure and financial gain, but which hinder the Committee’s ability to do its job – there should be consequences.'
The Iowa Republican doubled down on his calls for Avenatti to face punishment after NBC News published its report detailing his alleged misrepresentation of the second witness.
In an email to the committee on October 2, Avenatti submitted a second sworn statement 'from another witness who supports a number of allegations of Ms. Swetnick'.
The declarant, whose name was redacted, said: 'During the years 1981-82, I witnessed firsthand Brett Kavanaugh, together with others, "spike" the "punch" at house parties I attended with Quaaludes and/or grain alcohol. I understood this was being done for the purpose of making girls more likely to engage in sexual acts and less likely to say "No".'
The witness also claimed to have knowledge of Kavanaugh being 'overly aggressive and verbally abusive towards girls' including 'inappropriate physical contact with girls of a sexual nature' at the aforementioned parties.

Grassley's request for criminal probe into Avenatti and Swetnick's claims comes two weeks after the subject of the allegations, Brett Kavanaugh, was confirmed to the Supreme Court

According to Grassley: 'Mr. Avenatti neither provided the identity of the declarant to the Committee nor made her available for an interview with Committee staff. I also noted that, as of then, it did not appear that any media outlet had been able to report any interview with the purported declarant or validate anything in the anonymous declaration.
'However, after I sent you my referral, NBC News revealed yesterday evening that its reporters in fact had a series of contacts with the purported declarant between September 30, 2018, and October 5, 2018.'
In an interview two days after Avenatti published the second statement on Twitter, the woman reportedly told NBC: 'It is incorrect that I saw Brett spike the punch. I didn’t see anyone spike the punch...I was very clear with Michael Avenatti from day one.'
The woman also denied having witnessed aggression or abuse by Kavanaugh and said: 'I do not like that [Avenatti] twisted my words.'
When questioned about the discrepancies between the statement and the woman's own remarks to NBC, Avenatti initially said he was 'disgusted' with the outlet and later claimed that the statement had come from a different anonymous witness.

Avenatti welcomed Grassley's threat of legal action in a string of heated tweets on Thursday

Avenatti welcomed legal action in a tweet responding to the first DOJ referral, writing: 'Maybe if Grassley was actually a lawyer that knew something about the law, he would realize what he has done. He just opened up Pandora’s box as it relates to Justice Kavanaugh’s conduct. It is Christmas in October!'
The attorney who represented Stormy Daniels in her losing case against the president said: 'It is ironic that Senator Grassley now is interested in investigations.
'He didn’t care when it came to putting a man on the SCOTUS for life. We welcome the investigation as now we can finally get to the bottom of Judge Kavanaugh’s lies and conduct. Let the truth be known.'
Avenatti has also said that Kavanaugh, who denied all the sexual assault allegations against him in writing and under oath, should sue his client and other women who have made accusations against him for slander.
'If Brett Kavanaugh & his supporters are so convinced that all of the scores of women (inc my client) are lying, he is innocent, he has been so wronged, & his reputation has been damaged for no reason, then he should sue us all-TODAY,' Avanatti tweeted during the confirmation process. 'I hope that he does so we can prove the truth!'
Kavanaugh addressed the charge from Swetnick that he was aware of, and may have participated in, gang-rape when he was in high school at a Senate Judiciary Committee hearing at the end of September.
'This is ridiculous and from the Twilight Zone. I don’t know who this is and this never happened,' he said.
He claimed at the hearing that he was never sexually abusive to any woman, ever, and that he while he engaged in under age drinking he has never at any point in his life been blackout drunk.
Republican senators confirmed to the former federal judge to the Supreme Court with the assistance if a single Democrat nine days later.

I hope it does happen.....

He is trying to bluff with the "Kavanaugh will be reinvestigated!" ..... Sounds scared with how many times he had to post it over and over. Almost like he is trying to scare them away, when really he is the one scared of an investigation

I'm not holding my breath when it comes to Sessions. He hasn't even glanced at any of
the usual suspects, IE the Kenyan, the Granny, Mueller and his crew to name a few.

Avenatti is a 2bit shyster who should at the very least be barred from practicing law.
Sessions doesn't seem to be the kind of guy who's up to the task.

As for Kavanaugh, the fat lady sang right after Elvis left the building. He'll be a SCJ
for decades to come. He may even redefine the word "payback."
