The Recope Ruling Puts Costa Rica in a Dangerous Judicial Insecurity for National Investments

The Costa Rican Chamber of Industries shares its concern regarding the recent ruling that deemed the labor strike which affected the state refinery (RECOPE) legal. “This ruling attempts against the judicial security and the good direction of the country, its production, its citizens, its wellness”.
The strike at Recope (Costa Rica’s State fuel refinery) was initially declared illegal, according to the judge “the strike did not comply with the requirements stated in the labor code that movements must be peaceful, the alternatives of conciliation were not exhausted, and it did not have the support of a minimum percentage of employees“; however, a different judge ruled the appeal in favor of the labor unions, declaring the movement to be legal, under the premise that there was not enough evidence to determine that the movement was not peaceful and considered that the service offered by Recope is not essential to the general Public.
The Chamber of Industries disagree with the ruling and stated that it absolutely is an essential service, “In considering that the service of distribution of fuel is not essential, the court then considered that:

1. The fuel used by ambulances to carry patients to hospitals is not essential
2. The gas used by families, commerce and hotels to cook and feed is not essential.
3. The gas and fuel oil used by companies to continue operating and generating job is not essential, in a country where unemployment is of more than 10%
4. The fuel used by public transportation to take people to their jobs, education centers or medical appointments, is not essential.
5. The fuel used by farmers to produce the food and take it to the tables of all Costa Ricans is not essential.
“The regretful ruling by the court puts us in a dangerous judicial insecurity for national investments and the attraction of foreign investment which could generate more unemployment and with it more poverty”.
The Chamber of Industries supports the President of Costa Rica, Carlos Alvarado, on the decision to follow the process to refute this sentence and new ruling.
