WASHINGTON (Reuters) - The White House told Democratic lawmakers on Sunday that U.S. President Donald Trump and his lawyers would not participate in a congressional impeachment hearing this week, citing a lack of "fundamental fairness."

Trump's aides responded defiantly to the first of two crucial deadlines he faces in Congress this week as Democrats prepare to shift the focus of their impeachment inquiry from fact-finding to the consideration of possible charges of misconduct over his dealings with Ukraine.

The Democratic-led House of Representatives Judiciary Committee, tasked with considering charges known as articles of impeachment, had given Trump until 6 p.m. (2300 GMT) on Sunday to say whether he would dispatch a lawyer to take part in the judiciary panel's proceedings on Wednesday.

"We cannot fairly be expected to participate in a hearing while the witnesses are yet to be named and while it remains unclear whether the Judiciary Committee will afford the President a fair process through additional hearings," White House counsel Pat Cipollone wrote to Judiciary Committee Chairman Jerrold Nadler, according to a copy of a letter seen by Reuters.

Cipollone - while citing a "complete lack of due process and fundamental fairness afforded the president" in the impeachment process - did not rule out participation in further proceedings. But he signaled that Democrats would first have to make major procedural concessions.

Nadler has given the White House a Friday deadline to say whether Trump will mount a defense in broader impeachment proceedings.
The Judiciary Committee’s Democratic staff did not immediately reply to a request for comment on the White House's refusal to participate in the hearing, which would have been the first direct involvement by the Trump camp in a process he has condemned as a partisan "witch hunt."
Democratic U.S. Representative Don Beyer said on Twitter in response to the White House letter: "Not one process complaint made by the President and his Republican allies in Congress so far has turned out to be genuine."
Congressional investigators have been looking into whether Trump abused his power by pressuring Ukraine to launch investigations of former Democratic Vice President Joe Biden, who is running to unseat him in the 2020 presidential election, and a discredited conspiracy theory that Ukraine, not Russia, interfered in the 2016 U.S. presidential election.

Over the weekend, Brian Stelter aired a segment on Reliable Sources titled “A Tale of Two Fox News Judges” in which he expressed concern that “dissenting” voices like that of Judge Andrew Napolitano were being “drowned out by the sycophants” like Judge Jeanine Pirro.
“Do you think there’s room left for people like Judge Napolitano who are trying to explain to Fox’s viewers that Trump is in pretty hot water?” the CNN host asked.
Napolitano rarely, if ever, appears on Fox’s primetime lineup anymore, but he did sit down with afternoon host Neil Cavuto on Monday and delivered just the type of commentary that the president and his followers don’t want to hear.
Ahead of this week’s House Judiciary Committee hearing on the Trump impeachment inquiry, Napolitano said that in his view, the president’s actions with regards to Ukraine were “clearly impeachable, because it involves two potential crimes,” namely bribery and campaign finance violations.

“They are free to say that’s not an impeachable offense,” he argued, “but they are not free to say it didn’t happen, because the evidence that it happened is overwhelming.”
Meanwhile, the president and his legal team are declining to make either argument under oath, announcing that they will not be participating in the hearings because they do not “begin to provide the president with any semblance of a fair process.”
“I think the president would be very unwise not to send lawyers there,” Napolitano advised, at the same time saying it would be “unseemly” for Trump to appear himself while witnesses give testimony against him. “But I think he makes a mistake when he refuses to participate,” he added of Trump, explaining that his lawyers would be able to make arguments on his behalf and call additional witnesses to defend him.
“So it would be in his interest to participate in that, right? To exonerate himself or at least state his case?” Cavuto asked.
“Absolutely,” Napolitano answered. “He also loses the argument ‘it’s unfair’ if he doesn’t take the opportunity to participate himself.”
The segment ended with a brief discussion of former FBI lawyer Lisa Page’s new interview with The Daily Beast. Napolitano appeared to find some common cause with Page, who spoke out in the piece about what it has been like to be attacked and ridiculed by Trump.
“It’s a little surreal when the president tweets about you, having been there, even if he says things that you know are not true,” Napoliano admitted. “I can tell you that from personal experience, although my experience is miniscule compared to what she’s been through.”
That being said, he added that he would advise Page “not to say anything” further while she is “still a potential witness and even a potential defendant, depending on what the inspector general comes out with early next week.”

Maybe this is the reason Repubs are paying along.

Pushing back against impeachment continues to be a call to action for Republicans.

During an appearance on Huntsville, AL radio WVNN’s “The Jeff Poor Show” on Monday, Republican National Committee national spokeswoman Elizabeth Harrington explained how fundraising and activism for Republicans are on the upswing in the wake of the House Democrats’ impeachment push against President Donald Trump.

“It’s incredible,” she said. “We have an amazing grassroots army of volunteers, and that’s only skyrocketed since
the impeachment charade. We have thousands sign up to get involved off the sidelines. Every single month, we’ve broken records on fundraising — our joint fundraising with the Trump campaign. We’ve just never seen an off-year election like this at the RNC. We’re in a very strong position, and it is because the country is in a strong position, and the Democrats have all the losing arguments. So, we’re really energized. We’re really excited.”

Ha ha. The jokes on us.
