Any Lawyers Here?

My gf got a drinking citation on friday in Delaware County(Ball State) in Indiana. She blew a .03(she had one beer), anybody know what her options are? She called the court today and she said she would have a court date depending on if the DA threw it out or not, and would have to pay fines and court costs. And to go on the deferral program, that you had to hire an attorney. They said it does stay on your record, does this affect anything?

I know with speeding tickets, I went on the deferral program, then I got a ticket while on that, but in a different county, so I went to court and luckily the cop didnt show, so it got waived and didnt screw my probation.

Hire a lawyer! Its worth it! Guarantee he can get it reduced and nothing on your liscense. Go without a lawyer and you have a little chance of it getting reduced!

It was at a football players house and I guess they gave out a load of tickets, there were even a few high school recruits there, I bet the coach likes that.

I'm actually an Indiana licensed attorney. Go to the initial hearing, and plead innocent. Then ask if you can get pretrial diversion. You can probably do this without a lawyer. If you can, pay whatever fine it is (maybe $300), and keep her nose clean.

If you cannot get pretrial diversion, hire an attorney.

no, she wasnt driving, she was actually leaving when it happened, they had cops at both doors.

ok, so the court said that her court date wont be til like april, but her ticket says march 4th. SO i guess this is the pretrial right? Where you can stand before the judge, i remember something about this with traffic tickets, because a guy told me to go to this and ask for probation.

That is crazy that they made her take the BAC. I guess I am used to Louisiana law. A minor in possession in Louisiana is a misdemeanor. All you have to do is pay a fine. Good luck with everything.

When I was in the army some friends and I were 'having one for the road' while walking to a bar down the street. The cop pulled over, gave my legal friends $75 tickets for drinking in public while I ended up with a $50 minor in possession ticket. Those guys are still pissed at that discrepency.

There's lots of strange laws regarding alcohol posession these days...it all depends on where MADD sets it sights.

MADD is really tough in Louisiana. I got stopped for drinking and driving a few years ago, and I could not get it fixed. I had some big political figures in Louisiana write to the DA where I got stopped, and they could not do anything. They said if MADD found out that my ticket got dismissed they would press charges against the poilce department.

My guess is that she is underage - minor consumption. There's a lot we don't know from this limited description of what happened.

oh, my bad, yeah she is underage, I guess I thought it was understood, because people of age dont get drinking citations, I dont think.

Daringly, did you see my questions about the pretrial diversion and all that stuff? On the ticket, it says court date march 4th, but the lady that she called at the court said to not show up that day? So I am assuming that is pretrial, where you have the option of showing up?
