i used to live in the city but have now moved to the suburbs. while in the city, i accumulated a few parking tickets. i thought i had paid them all but, i just got in the mail a notice saying i owe $320 in parking tickets from 1999.

normally, i would just ignore such a notice but, i read it and it says that my wages could be garnished and my house could be liened. is that possible?

BLUE, CONTACT DOGBALL.

ALSO CHECK IF THE LOCATION OF THE PARKING

VIOLATION; IF THE SIGN OF REGULATION IS NOT

ERECTED ALL ONTO ITSELF BUT IS ADJUNCTED TO

ANOTHER UTILITY POLE THEN THE TICKET IS VOID

DUE TO VIOLATION OF CITY ORDINANCE

Once they I'm assuming the city of Chicago, gets a judgment against you... yes such things are possible. However, they need to get a judgment against you first. They can also prevent you from registering your vehicle, and renewing your license. You can attempt to take each instance to trial, however being from 1999, the time period to take such issues to trial has more than likely past, it is possible, however a question would be asked why it has taken 4 years. Personally, it would be easier to pay the $320.00, also if they have included additional fees, etc. I would settle with them, for the base amount. You could fight this several angles are available, however it would cost you more then the $320.00. My advice just pay it.

SINGURU is right, however we would need to know all the facts surrounding the tickets. Secondly, how many tickets are we talking about here?

dr. they are claiming that two tickets are unpaid. both have doubled and now they've added penalties, etc...so, we're at $320. i thought about paying it but, i'm not sure their claim is legit. i always paid the tix when i lived there because i saw a few cars with the boot and did not need that hassle...plus, if they catch me parking illegally i should pay the ticket.

these are my issues:

1) not sure if the tickets are legit (i.e. did i ever get them in the first place and if so, did i already pay them...we're talking 4 years ago and i can't remember last month)

2) this is the first notice i have rec'd on this and its four years later. come on!

3) how can i be sure that paying this notice will clear up the issue. the notice came from an attorney's office...not the city.

I'M no lawyer but I advise you to just pay them, at some point a warrant could be issued and you could find your car impounded and you spending a day in jail for a bad tail-light or some other reason a cop might have to stop you. Another problem like doc says is renewals. License, registrations, even insurance could be held up if you are in DMV computers as a scofflaw. Simply pay the tickets and make sure your name is totally clean with DMV once you do.

wil, you are probably right but...dammit! the city charged me $125/year for a vehicle sticker, the sales tax is through the roof, the streets are in horrible disrepair, you can't find anywhere (and i mean anywhere) to park in your own frickin' neighborhood when the cubs play a night game, etc. they just take, take, take.

maybe i'll wait til the last minute then pay it.

I am not an Illinois Attorney, however it seems that a firm has been contracted to urge you to pay the tickets. What I would do is check with the municipal authorities, I.E. DMV, Chicago PD, Parking.. etc to determine if you have any outstanding tickets, etc. Next, I would attempt to recover copies of the said tickets, you can subpoena this information, however it makes the process more long and drawn-out for a layman. The simple and best solution is to offer a written notarized response back to the Attorney in question, stating that you wish to challenge the validity of the tickets, thus you will have the option via discovery to see what the evidence is against you if this goes to trial. More than likely this will not happen, this firm has more than likely been contracted to attempt to recover "some" of the debt incurred from parking tickets, which in a city like Chicago are a scam anyway. However, before you do this check to make sure that this course of action will not impede you ability to drive in any capacity. The possibility of a warrant is also possible; however not likely, only if one forgets to show up to a court hearing. Who is to say that you actually received the tickets as well, they may have blown off your car window, etc. Pay only the original fine, because this is the first instance of notification that you had been issued parking tickets, also a timeless of prosecution issue may be possible, four years to notify someone, normally they impede one's ability to drive with-in six months to a year max. Sorry to cut this so short, I have some preseason to watch. Any further questions, just ask.

Blue, you need to know if you are dealing with a real collection agency.

If so, yes they could theoretically garnish wages after a civil court trial.

If it's not an actual collection agency, they are just throwing out threats. I have a friend who went through this with a private parking lot(he refuses to cooperate with anyone....lol), and he found out that he could tell them to go fukk themselves.

i called the attorney firm on monday. what i said is that i have no recollection of these tickets but i don't want my driving rights impaired so i am willing to just pay the original amount of the two tickets ($100) and be done with it if it will clear me. the guy said he has no authority to negotiate on behalf of the city and the only way to clear this up is to pay the full amount due.

after i got off the phone, i went down to the dmv to renew my drivers license (expired on my birthday last month). absolutely no problem getting a new license which expires 8/07.

i think i am gonna blow it off. let these frickin' jokers come to my door with handcuffs...then i'll pull out the checkbook.
