Is Cable Modem more legal than phone modem when betting?

The federal Wire Act of 1960, is about wagering over a telephone line, which is needed for a phone modem, which is why some say internet betting is illegal. But if you use a cable modem, eliminating the phone line, does this not make the federal Wire Act of 1960 void?

Are you a professional involved in the business of wagering? If not he Wire Act doesn't apply to you. State laws might.

I asked this question to a legal expert and he said a court would probably say they are included since these days phone calls are sent over the net and satellite, and wireless spectrum I presume.

Anyone betting sports on net or phone is breaking the law period.

You cannot bet on sports unless you live in Vegas and bet with licensed sportsbooks in Vegas and or Nevada period.

All the rookies popping in in this thread, let me deal with the legal issues and you boys try to beat the games

JJ may be a lot more correct here than many would care to admit. The problem however is NOT with the Wire Act or other federal law but it's STATE law you should be concerned with.

JJ right on money here. And I'll add from personal experience if you receive funds from offshore books or local books-that can be deemd illegal proceeds and siezed.

Also carrying a schedule book is illegal, promoting gambling and you could get arrested

Again you can only bet sports in Nevada and must be in nevada to place that wager

Gov't has bigger problems than slapping fines on bettors in usa

JJ you are obviously no professional if that is your advice when it comes to this. It is illegal to book bets anywhere without a license. There is no federal law against betting PERIOD! To say otherwise is a lie PERIOD. Is that clear?

I believe the count is something around 20 states or so that have laws against betting, but some may not really be enforceable. A legal expert guesses that maybe 10 states have a good law to stand on against offshore betting, but the proof standards vary. Short of having hard evidence of a crime they won't get a conviction. Hard evidence generally requires gathering proof from both sides of a transaction, although courts have leeway on this. In other words in some states they would have to seize your computer to prove you placed a bet and the books records to prove they accepted it. GOOD LUCK to the AGs of the states on that one.

great Post Wildbill...do you know off hand the 20 states that have laws against betting and/or the 10 states that have a GOOD law to stand on??

Billy if law enforcement comes into your home and go into your computer and see bets being placed and money being transfered from books to your bank, ect

when you say professional business of wagering, does that mean placing bets, or taking them? if one make a living from betting online, and not accepting wagers, this is not covered under the wire act from my understanding.
