Can a posting persona be used in a court of law?

What if a poster wanted to use other posters as character witnesses? If we wrote letters about the good traits of the poster, would the judge or jury be allowed to use it as a factor in the character of a person? What if 200 posters sent a letter?

What if Dante was on trial for whatever, could our letters be used in his trial as character referances? Character witnesses are very important, especially for 1st time defendants. I am just not sure they would be admitted by friends gathered from a posting board.

Gen, IB wasn't really a good example in the context of your question, but as far as "Can a poster be held liable for slanderous remarks made under a "posting nickname"?", IB is well aware of the answer of that one.

As far as the details of your question, I think the judge would laugh his ass off & probably claim that the letters were from a bunch of imaginary internet "friends".

The short answer is "no" because mere letters and posts would constitute inadmissable hearsay without the ability to authenticate the letters and posts were actually made by the person who purportedly drafted it. Moreover, any statement that goes to the "truth of the matter asserted" would have to be subject to cross-examination in order for the statement to be admissible for that purpose.

In theory you may state under oath that you post under a certain handle, possibly providing evidence ( IP match and so on ). If it were in Dutch Courts it would be admissible, have no idea if it can be in a U.S. Court.

I know for a FACT that my posting personna was indeed used in FEDERAL COURT here in Virginia in litigation with ESB/ATIYAH as well as SBG GLOBAL...

I agree TTinco and I am much more careful now than I was when posting years ago...

What you post about others, you better be pretty sure you can back up or you may find yourself in court as I did...

And even though the TRUTH is a great DEFENSE, the only ones who usually make out in civil litigations are the attornies...

This is a rather interesting thread. Going back to the original question posed by The General, I would guess no.

Whatever one writes on any forum about himself or someone else, could be fiction or the truth. So what is it this time, we can ask, is it the real dope or more BS?

For instance there was a poster at the Rx would told a lot of stories, I was reading them and all of the sudden, right out of the blue without warning, I was reading about a homo-erotica experience he had. Did that really happen? The courts would need the DNA.

What percentage in the courtroom.........lawyers, spectators, jurors, security, and the Judge himself will keep a straight face on when the prosecution calls FISHHEAD, SICK GAMBLER, or WINKYDUCK as the next witness?

Then, they will ask you more than what you could ever dream of wanting to answer...

At least at my old age, I was able to say "I can't recall" a lot and it was true..
