little off topic....anyone ever filed a wrongful termination against employer?

Seem to have knowledagble posters from all walks of life here that know their stuff. Basically I was let go yesterday for excessive breaks and my manager also read some emails where i vented my frustration to another coworker. I had to take prolonged (very moderately) breaks to stretch my back (L5-S1 on the mri)

I realize that for wrongful term, it's usually race or gender based but I'm looking at the American with Disablities Act angle.

I have a compressed disc. I answer(ed) emails for a brokerage company and sat ALL day long which finally took it's toll on my lower back. Spent 1600 on a tempurdeic bed which didn't help and thousands on physical and massage therapy. Basically I requested to move to phones that way I could stand about 1/2 the shift. They never accommdated me and just gave me a fancy chair.

Pretty ticked at this point. Had been with them since 1999. The only brightspot is I can now devote 80+ hours to capping and lurking forums while I hopefully collect unemployment. Started day 1 of unemployement hitting a 25$ 6 teamer so at least I have some bankroll to work with and won't miss a second of march madness.

thanks for any feedback guys and may karma deal with those who have wronged any of us in a fair manner

if you were having problems with your back, had you spoken to Human resources?

they should accomodate you with new chairs, different work stations, more flexibility?

but you need to discuss it with the company first

is unemployment paid for by the governement in USA? meaning other people's taxes?

if so.... it is disgraceful to drain this system while all you do is sit at home & gamble? (presumably at a desk behind a computer.... similar to your last job?)

no but I know a fellow employee that is going to sue for it ..they told her she will have a ruff time but she is going to try....I doubt she wins

Wrongful termination is tough to prove, but it sounds as if you could possibly have a case on the ADA angle. Employers are required to make "reasonable accomodation" for a disability. That definition is intentionally vague. Normally, one has to officially notify the employer of the disability and most employers will normally ask for some sort of medical backup.

I'd be sure that the rest of your "record" is "clean". Most people go down the ADA path once they've been counseled around performance issues and, by then, it is too late.

BTW, unemployment compensation is paid for by employers (not the government and not individuals, as is commonly thought. A lot of people think they're automatically entitled because they've "paid in to it". Not true.)

In Canada, unemployment insurance is paid for by the government....

over, here, many people also think they are 'entitled' to it becauz they have paid into it!!!!

failing to realize.... it is not a tool to allow you to sit on your ass, but rather, an emergency tool to help you out will you look for another job.

It also depends on the state. If your state is "employment at will", they can fire you for nearly anything, as long as it doesn't violate federal law (race, sex, or ADA). If you sent an "improper" email criticizing the company, they can likely use that as the basis for your termination, and forget everything about the lengthy stretching breaks. If they do that, you are SOL.
