Having had a few days to "cool off" and reflect back on the events in the recent player dispute with mybookie.com , I was able to ultimately come to the same conclusion as many people have expressed here, and that is that we were 100% wrong in withholding winnings in this case.

Although I was not involved in the daily activities of this players account I was the one that ultimately turned it over to our lawyer and agreed to the original settlement.

Yes there were suspicions and yes there were irregularities but that did not change the fact the player had won fair and square. I would like to believe that because we had a legal signed and notarized document agreed to by both parties ,we were right, but this is not about legal technicalities only about whether or not we acted in accordance with sound business ethics and on this I must say no we did not.

I did not put principals before personalities , as it became somewhat of a personal thing with certain promises and verbal agreements being broken . I am sure that our attorney also was convincing in his arguments (as that is what he is paid to do) to the player that it would be better to accept a settlement rather than have the account frozen and investigated for fraudulent activities.

I must say that initially when I was contacted by Roberto from TOW i was adamant in that we had done nothing wrong. Also when contacted by General and Shrink and Russ I felt we had a legal agreement and that was that, but after explaining to them all the details(which do not need mentioning) they still drew the same conclusion WE WERE WRONG.

At this point I was ready to fight and was convinced that if we went to arbitration that we would win (after all we had legal documents). Luckily for me this was not the end , I received another phone call from General and Shrink stating they had spoken to 6 different people in the industry and they all had the same conclusion WE WERE WRONG. I also got opinions from Russ at MW and Rick from my own staff who also stated WE WERE WRONG .

So after getting my pride and ego out of the way, and listening to what was being said from people whose opinions I respected I could draw no other conclusion other than WE WERE WRONG and agreed to pay the player in full.

I am sorry that it did have to go this far and that the people who work hard everyday at our company in which they take pride would have to be subjected to embarrassment for something over which they held no control. We made a series of bad decisions and I am glad that we were able to make it right.

We are also going to implement some player dispute policies in which RX, MW, and SBR web addresses and email addresses will be made available to players vis our web sites. This being an unregulated industry these sites do in fact hold operators to a certain set of standards.

Well, I respect you coming forward and admitting it. We all make mistakes, but it takes a hell of a man to admit it publicly. I am winding down and my Don Best goes off June 1. I will look you up in August and give you a try, if you have no reservations against FROG's. Just because of this post.

Best Wishes...OF:howdy:

I think a lot of positives came from this experience even though the reputation of the book was tarnished:

Positives:

1- They are solvent...they were able to pay out over $300k to a player
2- They have one of the most honest and respected linesman NOW on staff
3- They allowed the General and Shrink to openly communicate and mediate a dispute

Concerns:

My concern is their reputation and my thoughts that the owners are dishonest and have little integrity. This post goes a long way towards altering my views.

The key will be to see if this is a pattern that pops up with MyBookie or if this was a one time incident. I think with the staff they are putting in place (Rick is about as big a hire as any book could have) they will not be in this type of position again.

If in fact this is a one time error, I think it goes a long way that you would come on here and admit 100% fault and that you have paid the player. You can't ask for more than that from a player's standpoint.

I don't like the way it was handled, but that has been beaten to death and if you could, I am sure you would go back in time and handled it differently. This post goes a long way towards erasing my feelings on what can't go back and be completely erased.

I have made hundreds/thousands of mistakes in my life and all I can hope to do is learn from them and not put myself in the position to make those mistakes again. I think you have learned from this incident and would feel comfortable saying I don't think MyBookie will go through this again.

Good luck with your book and putting this behind you.

WHO WOULD EVER PLAY IN A BOOK THAT DID THIS. IF YOU ARE GOING TO RUN A BUSINESS KNOW WHAT YOU ARE DOING PERIOD. NO EXCUSES WHO CARES IF YOU APOLOGIZE NO ONE SHOULD EVER PLAY AT THIS BOOK. THE FACT IS SIMPLE THIS PLAYER WOULD HAVE BEEN SCREWED IF HE JUST WALKED AWAY. YOU DIDNT GET AWAY WITH STIFFING HIM BECAUSE IT WENT PUBLIC. SO WE ARE SUPPOSE TO SAY WOW WHAT A GREAT BUSINESSMAN YOU ARE BECAUSE YOU TRIED TO SCREW SOMEONE AND IT BECAME A PUBLIC NIGHTMARE AND NOW YOU ARE PAYING HIM.

ITS PEOPLE LIKE YOU THAT SCREW THIS INDUSTRY. IF ANYONE CONTINUES TO PLAY HERE YOU DESERVE TO LOSE YOUR MONEY.

I WISH PEOPLE WOULD TEACH THESE BOOKS TO RUN A FAIR BUSINESS AND NOT PLAY THERE AND MAKE HIM GO OUT OF BUSINESS. IT WILL TEACH THE NEXT SCUMBAG OWNER THAT IF HE DOES THIS HIS BUSINESS IS DONE. WE AS PLAYERS HAVE TO TEACH THESE BOOKS THAT UNFAIR BUSINESS PRACTICES WILL NOT BE TOLERATED.

sorry for the caps but didn't realize till after i typed and i am not retyping.

I still wouldn't play there public apology or not. Too many books out there that wouldn't have pulled that crap.

Believe me it doesn't remove the event from memory or having reservations of places that have track records, but it is still nice to see a book reverse course once in all a while, instead of playing the "syndicate" "steam" "collusion" etc..card to the very end.

I will give Mybookie a small shot this NFL season. However, as AK said, this guy only got paid because he came to the forums. That concerns me. How do we know that they are not others in a similair situation but we don't know about it on the forums?

Very good post Mr. Nichols.

This book has real potential. CRIS made a serious blunder too a few years back and look where they are now.

While I agree with a lot of what you said, and it is well documented in the other thread that I was one of the hardest critics on MyBookie regardless of paying the player, I think there are some things that should be looked at.

With most stiff books or books that give players headaches, there is a pattern of repeat behavior. What do they do to correct their problems? Not much...

MyBookie has admitted fault...100% fault in fact. Not only have they admitted fault, they have paid the player over $300k.

They have also solved the issue of poor risk management by bringing Rick on board. Rick would never allow this situation to escalate to where this dispute led if he was involved from the beginning. Anyone who does not know Rick and his history should not even try and argue that point.

The other point that was made that I respect and makes me feel confident this book is legit about their intentions to be a legit and solid out is the fact that he just said he is going to put links on HIS SITE stating players can come to The RX, Major Wager, and TOW if they have a dispute. That is a bold statement saying they have nothing to hide. My biggest concern was just like you said, what about the people that don't know about The RX? As I stated numerous times in the other thread...they would have stiffed that player. No doubt about it...even after this post, there is no doubt in my mind the player would have been stiffed.

But as he explained, he was adamant about his position at that point and this just goes to show the value of The RX. It changed his mind and he was a man about it and admitted fault. That is a sign of class, not a stiff. Granted it is a great PR move and a necessity in this situation, but still shows more class than whining about having to pay the player the extra $85k.

All of the concerns I had have been met and my bashing of the book will stop. I hope they do get things headed in the right direction because this industry can use as many solid outs as possible. From a player's perspective, the more quality books, the more value there will be for the player.

I will not forget what happened of course, but getting the lawyer involved was probably the biggest mistake of all. But, admission of guilt, hiring of class act Rick, the RX having mybookie's ear and paying the man in full are good enough for me. This is not an ongoing problem of late payments but a one time event of listening to bad legal advice. Been down that road myself. I vote yes.

Very good point PS. Luckily I am as clueless as they come. I think Rick will change that rep. If not, you will be the first I tell, you were right.
