Is internet gambling illegal in the USA?

I consider it legal. There seems to be nothing clearly making it legal or illegal. its all gray. Am I wrong?

At the federal level, gambling is clearly totally legal.

There are about 25 states that have individual gambling laws, 8 of which have specific internet gambling laws.

1 person has ever been accused, he was in N Dakota. He pled guilty before the trial and therefore the state law was never even tested. He got a 500 dollar fine.

Most gamblers think the Wire Act applies, but in the USA vs Baborian the US District Court clearly states that the Wire Act was created for TAKING bets not PLACING them. This is why Wayne Gretzkys wife is in absolutely no trouble, and nobody has ever been prosecuted for placing bets, even with a bookie.

Its not even grey. Its pretty black and white.

not illegal ..HUGE gray area

If it was already illegal they would not be trying to pass these laws on it that never go thru

Some states its a NO NO.

Overall, its in the Grey area, and Questionable at best!

Its black and white.

Some states have gambling laws and most are misdemeanors, and there are no federal laws that cover the bettor. 1 person in 1 state has ever been accused of gambling online.

Thats it in a nutshell.

No longer do I even ask about "legal in the USA". Now I say is it ok in the state of xxx?

Personally I would not do it in a few states such as Washington.

Very intelligent post. Anybody that saids it's illegal, are those that are either too paranoid, a little ignorant of a few federal laws, or,they misunderstand, and misinterpret the wire act.

Though it is CLEARLY black and white. I believe it is still a 'little' in the grey area.

That's a very good point. The key is that the authorities are not going door to door checking on what people are doing in their own homes on a computer (YET ANYWAY), as long as they aren't endangering anyone.

I still wonder about the man in North Dakota betting from home on his computer. I don't believe I ever heard the FULL story or as Paul Harvey used to say...."the rest of the story".

Internet gambling is perfectly legal.

The people that are misinterpreting it are those that don't realize that the wire act was to stop illegal horse betting. Has nothing to do with the internet.

Gretzke's wife was involved with a local guy.

I think his bank (Wells Fargo) turned him in. He puts 'professional gambler' on his tax returns, loan applications and so forth. Local law enforcement, looking into the bank tip, thought he was a bookmaker and that is why he was investigated initially.

He used to post some across the street. He moved to Kentucky and so far so good. The Kentucky AG informed his lawyer that Internet gambling did not appear to be illegal in that state, but would not put it in writing. I asked him how things were going some time ago and he said he still worried about having his computers confiscated again and going through all that hassle. He also does not keep cash at home anymore. He had $50,000 in his desk when the Sheriff searched his home.

You will find dozens of articles. He thinks it was either his bank or his family - for religious reasons - that turned him in.

Either way, the key is that he didnt fight it. He pled guilty immediately and took the 500 dollar fine as a misdemeanor and moved to KY.
