The Senate has a 27 day window until they take a month long break, and then they’re back for a month until early October. If the Senate does pass this, and Bush signs it into law, how likely is it that a judge orders a stay of execution on it or just outright overturns it, calling it unconstitutional? How many laws have been passed by Congress, presidents, or popular votes only to be overturned by judges in the past?
