An offense shall be an extraditable offense if it may be punished under the laws of both Contracting Parties by deprivation of liberty for a maximum period of more than one year or by any greater punishment.
From the treaty - seems to me since the charges against them are all related to "illegal" booking, CR would not extradite as it is legal there.

CR will not extradite for booking bets.
Now if the US can show other crimes (Selling illegal drugs, beating the crap out of people, etc), then CR will extradite.
If the US thought CR would extradite, the US would have put out arrest warrants on June 1st when they got the indictment. Instead they waited till he was on US soil because they know CR will not extradite.
The US likely really wants Kaplan but knows he never comes to the US and they will never get him.
