CEO of Internet gambling business stays in jail

<!-- begin body-content -->FORT WORTH, Texas - The chief executive of a major online sports-betting operation remained in custody Friday on racketeering and conspiracy charges after his lawyer asked to postpone a bail hearing.
The hearing for the CEO of BetOnSports PLC will be held instead in federal district court in St. Louis. No date was set.
The executive, David Carruthers, was arrested Sunday at Dallas-Fort Worth International Airport as he waited to board a flight to Costa Rica, where the company has a major operation.
Carruthers and 10 others, including the founder of BetOnSports, were named in a 22-count indictment unsealed this week by federal prosecutors in St. Louis. The government says BetOnSports fraudulently took bets from U.S. residents by phone and the Internet, and failed to pay excise taxes.

mhhh.... the more i read about this the more it makes me believe BOS is the only target for the DOJ.

There is also other moves by outside books like eurobet which makes me think otherwise. But i guess there move was just one out of trying to avoid a future crackdown.

One thing I got from this is that he will REMAIN in jail and as long as he is in Jail BOS will not be bring the website back up...JMO
Also he or his lawyers requested the postponement, which tells me that his lawyers are not ready to take this to court. Probably will be a while before he even gets a chance at release...maybe 7-10 days, these lawsyers that are going to defend him are gonna make some serious $$

David Carruthers has had his request for bail refused and has been detained and sent to Missouri for further process, according to a clerk of the court in Forth Worth. eGaming Review will update on further developments in due course

FORT WORTH, Texas, July 21 (Reuters) - Online gaming group BETonSPORTS (BSS.L: Quote, Profile, Research) Chief Executive David Carruthers waived his right to a detention hearing in federal court on Friday and will remain in custody.

At a brief hearing, U.S. Magistrate Judge Charles Bleil ordered Carruthers to be transferred to the Missouri district, where a federal grand jury issued an indictment charging 11 individuals and four corporations with racketeering, conspiracy and fraud.

Carruthers was arrested earlier this week as he changed planes in Dallas en route from Britain to Costa Rica.

Online gaming firms face uncertain future

In light of racketeering charges against the chief executive of BetonSports it should come as little surprise that key players in the online gaming industry were feeling edgy about their whereabouts this week.

Amid worries that the FBI will widen its crackdown against the industry in the US, executives decided that an industry conference in Las Vegas probably wasn’t the place to be in the next few days.

According to organisers, there was “a high level of concern” over uncertainty surrounding the US government’s recent actions against BetonSports. The event will be now held at a later date – at an international location.

The level of unease stems from the many question marks raised by the charges brought against Scotsman David Carruthers and 10 other individuals.

BetonSports and the co-accused were charged under the Wire Act which outlaws “the placing of bets or wagers on any sporting event or contest” via a “wire communication facility”.

The indictment handed down by the Department of Justice particularly referred to “illegal wagering on professional and college football and basketball” which BetonSports offers on its website.

But the case has exposed what many see as inconsistencies, as well as thrown the whole future of internet gambling in the US into doubt.

In particular, it opened up the question as to whether the internet constitutes a “wire communication facility”, and whether poker and casino games such as blackjack constitute a “sporting event or contest”.

It is a legal grey area which legislators want to clear up when a new bill reaches the Senate later this year. The proposals, which passed the House of Representatives last week, seek to outlaw the use of credit cards to settle online bets – pretty much wrecking the online gambling industry.

Mr Carruthers has been among those most vocal in opposition to the proposed law, although he admits that some degree of certainty is needed so everyone in the sector knows where they stand.

At the moment the grey area of US law can only be decided with any authority by the courts, meaning that the share prices in London of key internet gambling stocks were the subject of sharp fluctuations this week.

Shares across the sector were badly hit as nervous investors deserted gaming firms, although sports bookies like Sportingbet fared far worse than those which focus on poker, such as Gibraltar-based PartyGaming and 888 Holdings.

BetonSports shares fell 17% on Monday following news of the arrest of Mr Carruthers and they were suspended on Tuesday when details of the charges emerged. Sportingbet was down 13% and 35% over the two days.

Shares in PartyGaming, however, fell 6% on Monday and 17% on Tuesday, while 888 was down 5% and 13% respectively – a much less dramatic fall than their sporting rivals.

PartyGaming was last year’s growth stock in the FTSE 100 Index after joining the London market with a valuation of £4.64 billion – higher at the time than many traditional UK stocks such as Sainsbury’s. It represented the emergence of a new industry to rival the dawn of the dot.com era.

But this year it is a different story for PartyGaming as shares have fallen by 23% in the last month.

The company says it is unconcerned by the BetonSports developments as it does not have a US-based sportsbook.

However, it also highlighted the need to expand internationally and diversify from the United States, where it generates around 73% of its revenues. Last year the figure was 90%.

While analysts believe there will be insufficient time for the bill to pass the Senate, there is concern that there remains a sufficient level of support to bring about some kind of legislation.

It has left investors pondering whether to take a gamble on the sector once again.

BODOG Entertainment Group, an operator of several online gaming sites, said it had cancelled an internet gaming conference set to kick of next week in Las Vegas following the US government crackdown on operators of gaming sites.


"The US Government has made it clear that anybody who is involved in internet online gaming is not welcome in the US," said Bodog founder and chief executive Calvin Ayre in an interview from San Jose, Costa Rica. Shares in online gaming sites plunged earlier this week after Betonsports chief executive David Carruthers was arrested after landing at a Texas airport. He is to face racketeering charges for taking online bets from US customers.
Mr Ayre said conference attendees had begun to cancel their travel plans amid fears of further arrests. He added that the conference would be rescheduled "in an international location" at a later date.
Meanwhile, the lawyer for Mr Carruthers, Tim Evans, said he did not expect the Betonsports chief executive to be granted bail under conditions that would allow him to return to Britain.
He believed his client would have to remain in the US while awaiting trial and might have to wear an electronic tag if he was released.
"I think the Government's position is going to be that the offence for which he is charged in the US is not an offence in the UK," said Mr Evans.
"I don't know if that's an absolute bar to extradition but as a practical matter that would mean he couldn't be extradited if he went back.
"He's a very intelligent person and he realises that, at least temporarily, there's not anything he can do about it."
Mr Evans said that while he was not aware of a specific precedent for the case, he noted that the Government did not request the detention in jail of three former Natwest bankers from Britain recently extradited to the US for their supposed role in fraud at Enron. They were granted bail last week by a court in Houston.
Internet gambling on most sports is illegal in the US and as a result many online gambling companies, much of whose trade originates in the US, have set up offshore centres to circumvent US laws.
With Betonsports under attack for running sports books in the US, other companies in the sector attempted to persuade investors that they did not face the same risk.
Online casino operator Gaming VC gave a "geographic clarification", reminding investors that it had "no online operations in the US and does not transact any wagering activity on behalf of players in the US".
Software provider Playtech pointed out it was "not an online gaming operator" and its clients did not offer bets on sport. Interactive Gaming did not deny offering bets on sport but said it had a "long-standing policy of not taking wagers from the US".

Totally correct-- else they wait for the gaming conference-- the guys they have could always be snagged later, as they often flew in that manner.

LONDON -(Dow Jones)- U.K.-based betting and gaming group Ladbrokes PLC (LAD.LN) is still reviewing whether to accept U.S. customers on its online gambling sites amid ongoing regulatory uncertainty and the recent arrest of BETonSPORTS PLC (BSS.LN) Chief Executive David Carruthers.
A Ladbrokes spokesman Friday rejected a newspaper report that it had shelved its U.S. review, which included an entry into online sports betting.
"No decision has been made and sports betting was never part of the review," he told Dow Jones Newswires.
Rather, Ladbrokes is reviewing whether to accept business from U.S. customers in regards to poker and casino games online. The company will provide an update on the review around or in conjunction with the group's interim results on Aug. 24, he added.
At present, Ladbrokes doesn't take any bets from U.S. customers. The decision to review its current policy follows the GBP3.3 billion sale of the Hilton International Hotel division to its namesake, Hilton Hotel Corp. (HLT) in February.
The U.S. Justice Department has said that the 1961 Federal Wire Act, which outlaws sports betting across state and international lines, makes gambling sites illegal. But some U.S. federal courts have ruled that the law only pertains to sports betting.
Ladbrokes is also keeping a close eye on recent events in the U.S. including the passing of a bill that would prohibit most forms of Internet gambling and make it illegal for banks and credit-card companies to make payments to online gambling sites, he said.
As a result of the bill passing the House of Representatives last week, it will now head to the Senate for approval, where many analysts expect it to fail. However, time is running out with U.S. mid-term elections scheduled for November.
Shares in junior online gambling group, BETonSPORTS, were suspended on the London bourse on Tuesday following the indictment of its founder, Gary Stephen Kaplan, Carruthers and others by the U.S. Justice Department.
Carruthers has subsequently been arrested and is scheduled to appear in a court in Texas later Friday.
At 1452 GMT, Ladbrokes shares were down 2.50 pence, or 0.7%, at 379.75 pence, valuing the group at GBP2.36 billion. The broader U.K. market is down 0.7% at 5770.90 points.

Players report that the popular online site owned by Danish poker champion Gus Hansen and licensed in Malta, Poker Champs.com, is closing it's doors to U.S. players - possibly as a result of the Betonsports issue.

Poker Champs U.S. players have apparently been receiving emails from the poker room advising them as follows:

"As part of the recent upgrade, PokerChamps has performed a system change that begins the process of moving to a new platform.

"We have also incorporated geo-location software which enables us to implement a long standing and consistent group company policy of not permitting access to individuals in the United States.

William Hill gambling group, which had no problem with being identified in expressing an opinion on the US developments, told the Guardian newspaper that it was not unduly concerned by the events in the United States.

Chief executive David Harding said: "We are doing nothing illegal ... It [the indictment against BetonSports and others] doesn't worry me at all ... If it gets the Wire Act into court and there is any evidence that casino or poker bets [over the internet] are illegal, then we will stop it."

William Hill stopped taking sports bets from the US ahead of its flotation four years ago. It continues to take casino and poker bets."
