BETonSPORTS hopes to reopen within a week

LONDON (Reuters) - Internet bookmaker BETonSPORTS <BSS.L>is hoping that the sacking of its chief executive will prompt officials to allow it to reopen its Web site "within a week," the Daily Telegraph said on Thursday.
The group, which removed David Carruthers on Tuesday following his arrest in Texas on racketeering charges, hopes the move will give it enough leverage with the U.S. Department of Justice to reopen, the paper said, citing a source close to the company.

BETonSPORTS has complied with a U.S. demand that it close its sports betting operations for U.S. customers.
A U.S. judge on Wednesday extended a restraining order that bars the Internet bookmaker from accepting wagers from U.S. bettors at least through July.
The company could not be immediately reached for comment.

More bad news for BetOnSports and thousands of players who have yet to be paid by them. A federal court has extended the temporary restraining order issued against BetOnSports until July 31, 2006. This gives the Feds time to seek a permanent injunction, which would ask the court to have BetOnSports shut down permanently.

No attorneys even showed up for this hearing for the defendant and they have yet to respond.

Players who have accounts with BetOnSports have yet to be paid despite the Feds ordering them to do so. Fear and panic are running wild across many gambling and sports forums because gamblers claim they are being misled by some of the company's clerks who are answering the phone and giving out wrong and misleading information.

hey max lets say the restraining order does get lifted wouldnt england freeze millenium so everyone wouldnt be able to take their money out?

Since then its website has been closed not just to Americans but also to punters logging in from Europe or Asia. However, a source close to the company said: "We're getting our ducks in a row, both legally and commercially. We're going to be back on-line within the next few days, I hope."
His comments came just a day after the company sensationally sacked David Carruthers as he languishes in a Texan jail, a move that has been widely criticised by industry players and lawyers.
How much of the website would be opened is still being negotiated and it is uncertain whether the company will be successful. The 22-charge indictment issued by US attorneys in Missouri lists BetonSports alongside Mr Carruthers and the company's controversial founder, Gary Kaplan. The indictment makes clear BetonSports.com "operated illegally in the US".
However, the company source said: "There is a major matter of jurisdiction here. Who says the DoJ has jurisdiction over a company that is listed in London, with licences in both Costa Rica and Antigua?" He said one of the options for the company was to ignore the DoJ's restraining order and open the site regardless. "Let's see the DoJ come and try to stop us."
A more likely scenario is that the company will close down its telephone betting service, unequivocally illegal under the US Wire Act, and possibly some of its sports betting website, but keep up its poker and casino side.
Even if the sacking of Mr Carruthers is enough to win over the DoJ, the move has shocked the industry. A source close to Sportingbet, BetonSports main rival, said: "He's been hung out to dry. It's just extraordinary."
Andrew Brown, a partner at the City firm Herbert Smith and a leading employment lawyer, said: "There is the concept of innocent until proven guilty, which pertains to employment law as much as any other area of law. The fact that he has been sacked after being merely arrested rather than being convicted is very unusual."
Mr Brown urged directors to examine their liability insurance to check they are covered for being arrested on criminal charges.
Partygaming, the largest online gambling company, said that all its directors were fully indemnified even after they left the company.
Meanwhile, the anti-online gambling movement in the States has received a big setback. The Senate majority leader, Bill Frist, said the Bill that would outlaw transfers of money between banks and betting websites was not a priority. With only a few legislative days left before mid-term elections, the Bill is now likely to go unheard.

I have no idea what England is going to do. Some others have mentioned here that they will try to get back on the AIM before they launch the websites. I am on the look for any stories from AIM as to when they will get listed, but I would have to agree that any news by AIM would signal a restart of their operations....JMO

Thats the best news of all because it takes the fear out of new $$ coming in before the busiest time of year for books IMO...football season.

If they open I think I'll play until I reach the rollover bonus. Was 3/4 of the way there and had a bit of a profit going. Sure, just the deposit back from betmill would be nice though.

5dimes rocks!! They have the most lines than anyone else and never a problem w/ them for over 2 years. The only draw back is their website WILL slow to a crawl during the Football season. Usually an hour before games on Sunday and intermidently on Saturdays before major games go off the board.

5dimes is a great book for a small player like me. I play anywhere from $100 to $500.00 on a game and never have a problem w/ them. I use a T-Mobile Sidkick handheld device and make all my wagers on their alternate site www.propbet.com. I never have to talk to a live person over the phone. I can deposit, wager, and withdraw without talking to a person....I love it!!

PartyGaming has instructed its executives to avoid travel to the US, following the arrest and indictment of BetonSports CEO David Carruthers last week, but the Gibraltar-based online gambling company is to press ahead with their first major advertising campaign for their online casino, PartyCasino.
PartyGaming executives will seek legal action if travel to the US is deemed necessary but they insist they will not be driven out of the US market by the blurred legal situation. The US market contributes over 75% of PartyGaming's total revenue.
PartyGaming has heavily marketed their online poker room, PartyPoker, over the last five years, which is one of the reasons PartyPoker is now the largest online poker room in the industry. But, until now, the company's online casino games at PartyCasino have not been a part of any major advertising campaigns. The PartyGaming marketing department is about to rectify this with a "strong branding campaign" across Europe and North America in the near future.
PartyGaming Chief executive Mitch Garber said the Department of Justice action against BetonSports would not stop his company from "legally marketing in the US" through a variety of multimedia channels. The PartyCasino marketing campaign will utilize internet, television, radio and newspaper advertisements as well as sponsorship deals to generate brand awareness.
"We've had success with PartyCasino even before we've pumped up the advertising," Garber pointed out, revealing that Blackjack was a huge hit for PartyGaming when it was launched last October.

I figured that closing down their sports betting sites and just running their poker and casino room was going to be a logical thing for them to do............That would suck, but at least we'd have access to our money I suppose.

Just when we thought the news regarding BetOnSports couldn't get any worse, it appears that Bet On Sports may be closing for good. In a shocking development today, all sponsors of BetOnsports have been getting emailed or telephoned. The company is not only asking each to cancel its ads, but BetonSports is asking all for pro-rated refunds.

When we interviewed a spokesman named Freddie for BOS, he said, "We are trying to comply with the DOJ."

In my opinion, complying with the DOJ means they have no shot at reopening and BOS has just sealed the deal.

When asked why refunds haven't been sent out to worried customers, he said, "Don't worry. BetOnSports has all the money owed out to its members in a separate bank account but the means of sending it is much more complicated than you can imagine."

Another representative who we interviewed and asked for anonymity from Bet On Sports had harsher words to tell us. He said, "trying to deal with the DOJ is crazy. They are actually imbeciles and basically flushed this company down the toilet. This is really f***ked up, and is going to ruin the industry forever."

He concluded by saying, "this gives them a license to f***k around with anybody or any company they want."
EOG has also learned that some of the fugitives have extradition concerns and a couple of them met with their attorneys yesterday to address this issue.

At a time when the online gambling industry appears to be in the public eye, trust is paramount to survival. Therefore, it is paramount that BetOnSports pays out all of its customers, sooner rather than later.
