Vice President of Costa Rica: Gary Kaplan would be extradited to US

Though he hasn't been caught yet, Sylvia Alvarado Marenco of Costa Rica newspaper Al Dia reports that BetonSports.com founder, Gary Kaplan, can be extradited back to the US by the Costa Rican government.

A federal grand jury in the Eastern District of Missouri returned a 22-count indictment charging 11 individuals and four corporations on various charges of racketeering, conspiracy and fraud. Kaplan, the founder of BetonSports.com, was named in the indictment along with the company itself and the CEO, David Carruthers. Some of the marketing people were arrested in the States.
"The extradition is possible if they comply with the diplomatic processes and corresponding courts, although in the country of Costa Rica it is not illegal for a company to take bets over the Internet, explained the Vice President Laura Chinchilla.

Interpol reported that they had not yet received an American request to locate Mr. Kaplan. His location remains unknown.
Some websites and publications have reported that Costa Rica would not extradite Kaplan. This is not the case, however.

"That was never said. Nothing has to see that the crime exist or not in Costa Rica but rather another country that recognizes it (crime) and that we have a covenant of extradition, as in this case", emphasized the Vice President.
David Carruthers, president of BETonSPORTS, that operated in the mall San Pedro, is prisoner in Texas since July 16, defendant, al the same as Kaplan and other nine people, of blackmail, fraud and tax evasion.

Chinchilla added that the State he is "worried, therefore not a regulating framework of those businesses exists, above all in the financial environment, to guarantee us that not activities of money laundering be concealed".

"Because it worries is us that we prompt the reforms to the law of psychotropic and of casinos, (are likely). The ball, right now, (is in the hands of) the Assembly. The city halls also, therefore if them do not they give permission and clear, they would not be able to be installed in their zones".

A reporter for the Costa Rica newspaper Al Dia tells Gambling911.com it simply is not true that the Costa Rican authorities would not extradite BetonSports.com founder Gary Kaplan if found.

Gary Kaplan along with 10 others from BetonSports.com, including its CEO David Carruthers, were indicted early last week for various felonies including racketeering. Carruthers, a British citizen, is being held without bail in Dallas after being detained changing flights at that city's airport.

"Our government will abide by the US request," said the Al Dia reporter, who has already been in touch with government officials there. "The crimes mentioned occurred on US soil so the Costa Rican government would extradite him (Gary Kaplan)."

Kaplan and a handful of others including Norman Steinberg, former CEO of BetMill.com, remain on the lam.

Gamblers remain in the dark after BetonSports management shut down the website, supposedly as a means to comply with US prosecutors orders.

However, no deposits have been returned to customers as ordered by US officials. The company also fired its CEO on Tuesday.

The sports betting website of beleaguered internet gambling company BetonSports will continue to be closed to customers until at least the end of the month after the US Department of Justice won an extension to its temporary restraining order against the company.

BetonSports, which had been on a buying spree of other online sportsbooks of late, will probably never regain its status again as the number two online sports betting company. It's future on the London Stock Exchange also remains in serious doubt.

The five-day extension, granted in the DoJ's favour, means the company's hopes of getting the site up and running "within a week" could now be in jeopardy.

Court documents filed at Eastern District of Missouri reveal that the hearing for preliminary/permanent injunction against the company will be held at 2pm on Monday, July 31, in St Louis, Missouri, before Judge Carol E Jackson.

On the same day, an arraignment hearing will be held, when all defendants in custody involved in the case, including dismissed BetonSports chief executive David Carruthers, will have the charges read to them.

A spokesman for the US Attorney's Office could not say whether Mr Carruthers will appear at the hearing.

Non-executive directors of BetonSports will not be present at the injunction hearing in the US, having left Costa Rica, where they were holding an extended board meeting, to return to the UK.

A company spokesman said the extension to the court order was issued because the DoJ had yet to serve the company with documentation. He said the extension did not change anything.

BetonSport's shares, which are quoted on the London Stock Exchange, were suspended on July 18 at the company's request.
