I'm not sure if this is true or not....but I hope it is

Not Showing up for court part of BetonSports legal stradegy..

LOUIS (Reuters) -- Several people indicted in the U.S. crackdown on Bet on Sports Plc pleaded innocent to racketeering and other charges Monday, while a judge extended to Aug. 14 her order barring the online bookmaker from taking U.S. bets.

Prosecutors had suggested extending the ban while they resolve questions about whether Bet on Sports was served with the charges legally at its offices in Britain and Costa Rica.

A defendant in U.S. criminal proceedings - whether a company or an individual - must be contacted directly by the complaining party. Prosecutors told U.S. District Court Judge Carol Jackson that Bet on Sports was served legally.

The company, three related Florida firms and 11 people were named in a 22-count indictment unsealed in St. Louis this month charging them with racketeering, fraud, tax evasion and conspiracy. Seven of the individuals pleaded innocent on Monday. All had been free on bond.

David Carruthers, the fired CEO of Bet on Sports who was arrested by U.S. authorities while passing through a Texas airport earlier this month, was to appear in court later on Monday.

The company once again did not send a lawyer to the court hearings in St. Louis, triggering questions about whether it would seek to defend itself or instead take a position that U.S.-ordered sanctions against it were unenforceable. So far, the company has complied with the U.S. judge's order not to take wagers from U.S. bettors.

The charges allege the company failed to pay U.S. excise taxes on more than $3.3 billion in wagers taken from U.S. bettors. The government said it seeks forfeiture of $4.5 billion, removal of U.S. access to Bet on Sports' Web sites, and the return of money held for U.S. account holders.

Prosecutors told Judge Jackson that a U.S. lawyer had advised Bet on Sports about whether to send a representative to court, but that the company had decided not to send a lawyer.

"By not coming to court, you can make the assumption that since we weren't served, we can carry on our business in a normal capacity," said Kevin Smith, a Bet on Sports spokesman, after the hearing.
Prosecutors had sought to make the ban on U.S. bets permanent, pending a trial.

Entering the not guilty pleas in another courtroom in St. Louis before U.S. Magistrate Judge Mary Ann Medler were Neil Kaplan, Lori Kaplan-Multz, Tim Brown, William H. Lenis, William L. Lenis, Manny Lenis and Monica Lenis.
The Kaplans are related to Bet on Sports' founder, Gary Kaplan, the subject of a U.S. arrest warrant, while Brown once held a low-level position. The Lenis family members held positions with Florida firms involved in the online betting operation.
An attorney for one of the Florida firms, DME Global Marketing & Fulfillment Inc., entered a not guilty plea, while two other companies did not enter pleas.

Not for another couple more weeks it seems....looks like they'll miss out this season, either way, they will be struggling with all the withdrawls that they're probably gonna get.

Will BOS Re Open?

Here is my take

Their public listing in <st1:country-region w:st="on"><st1:place w:st="on">England</st1:place></st1:country-region> is all but gone. Nothing to salvage there.
They no longer have an obligation to shareholders as the Bush DOJ did damage that is all but impossible to undo without regard to the shareholders.

Could be why many of the BoS Brits have gone back to <st1:country-region w:st="on"><st1:place w:st="on">England</st1:place></st1:country-region> in recent days.

Not sending Lawyers to the court hearings makes no sense. Unless we consider the possible reasoning behind the current strategy.
And that may be for BoS to totally distance themselves from both the Stock Exchange and the DOJ.

Other than DC, no other current management or employees were included in the indictment.
DC was let go last week so BoS is now on their own.

On Their Own means that they have no people working in any capacity related to the indictment.

The indictment is against individuals. This may prove to be important.
Previous success stories with the Missouri DOJ gang were against the likes of The Discovery Channell, PayPal and so on.
All were companies. All companies were given an option to settle.

BoS has not been given an option to settle. Despite the fact that DC may be totally innocent of the charges.

[FONT=&quot]The case is being settled by a Restraining Order against a foreign based company. The Busch Camp lost their battle vs <st1:place w:st="on">Antigua</st1:place> and lost the appeal as well.

Makes sense that BoS will respect the DOJ for only so many days. They will then re-open with the support of the WTO and the Costa Rican Government which has already shown support by refusing the DOJ demand for the extradiction of Gary Kaplin.

One other thing that BoS has on their side is the U.S. Constituntion.
On the federal level, the requirement of equal protection is contained in the Due Process Clause of the Fifth Amendment to the U.S. Constitution. The Equal Protection Clause of the Fourteenth Amendment extends the prohibition on selective prosecution to the states. The equal protection doctrine requires that persons in similar circumstances must receive similar treatment under the law.

Bottom Line: BoS should be able to ignore the Restraining Order as it does not apply to them, as a company, but to those indicted.
They are as free to conduct business as BetCris, Pinnacle etc.[/FONT]

here here I may withdraw just a few hundred of mine for safetiers sake but am not goibng to totaly remove it we all need to call Betonsports and complain it has been two weeks now that we can't bet our funds we should ask if they could set us up with another sportsbook if they are not going to reopen hate to miss a bet on nascar or pre-season football Argh and hate to leave BOS because they have given me numerous payouts but, I hate to see my funds sitting there collecting interest for them when I could be betting elsewhere and maybe winning more $$$ as well Here';s to hopeing they don't stiff and what's with not showing up for court lawyers? atleast act as if you care please for your customers peace of mind have2bet

Still dont know what to think of the lawyers not showing....but the lack of info from the company has always put the fear of a stiff job in me. I just talked to a CS rep and still no new info on the what will happen BOD are metting now to discuss whats direction they will take now. Hope this was part of a plan but who really knows waht they are doing.......

wonder why the lack of info as well it makes no sense at all I would think they would want to open back up but, as I said above we as customers have a right to the funds in our account at this moment and it will do more harm then good if they stiffed people I sure hope the RX insurance policey should that happen covers junior rxers too for our sake

hey there have2bet welcome to the forum. since i been here theres been alot of support and alot of knowledgable people offering updates and opinions(good and bad) as far as our situation, tomorrow bos will know about the extension and im going to ask to at least have my original deposit transferred to another sportsbook if possible. read kevin smiths comments up above and i feel theres no reason they cant open or so thats how i view the companys stance. this unfortuantely is going to last a while.

Alas, it has been two weeks to some, like myself tweo decades since we have been allowed to bet our money at the BOS books the way I se it is the DOJ wanted our money returned anyway so, wouldn't they just be doing what the court order asked them to do by transfering to another book? I just may try this later on this afternoon and will update if I do then, if when they do get back up put a deposit in for say a nickel and see what kind of bonus they will offer once they get back up? also, ask what bonus they will have for sticking around and get the persons name confirm with manager so they can't say "we didn't say that" wonder if I opened up a heritage account if they would transfer it there Has anyone used heritage sportsbook before if so, are they good payouts wise?

Yes - no incentive to open back up. Only bad things happen by opening back up. Move the money before the US or UK manages to seize it. The US will fail, but the UK will have jurisdiction for security fraud.

My guess is the money is long gone into countries that don't extradite or disclose funds.

It's one thing to have to leave the U.S. to run a gambling company. You've gotta do hard work to have to run from that country too!
