My take on this entire fiasco...

I wrote this under the law description thread, but figured I can make it it's own thread.

How or why did it happen? That is like who left the barn door open, after the horse has already ran out. But, I believe three things, BOS, the religious right pressing Frist and the rise of online poker. To the gov, BOS was the smoking gun. All this internet gambling is just a ruse for the mob to launder money, diversify assets and evade US racketeering laws. All the critics point at Kaplan and mob pals as why this must stop.

Frist was pressured from the religious right to show a tangible victory before the elections. That is why is kept running around looking for a bill to attach his to. He obviously made it lucrative for the port bill sponsors to tag along. From support to campaign contributions, it could be anything.

The rise of online poker was just a slap in the governements face. Betting offshore went from low profile degenerates looking for action to mainstream poker players growing geometrically by the year. The visibilty, mainstream coverage and advertisement turned betting offshore to barely under the radar to flying in the face of the gov.

OK. Now that the blame game is done and the horse is gone now what? Boy, people were so skeptical, even myself, that this was just another dog and pony show that not many had a contingency plan if it did happen. You will see many panic moves, especially by publicly traded corps. You will see their stock prices plummet. Already have. Most will use the BOS example, we do not want to put our corporate leaders at risk. They will save their own asses first, and not care about fighting the good fight.

The books, mainly those not publicly traded will take a wait and see approach. They barely have anything to fear. The smaller books may fold up the tents and go home, but they were on thin margins anyway. The books are mentioned as potential criminals but the real target is financial transactions. Not the books, not blocking isps.

Funding. There is the gotcha. They knew the only bite they think they have is financial transactions. However that is a big think. There is no plan in place. There was no feasibility study. Many beleive it cannot be enforced. With major drains fighting other failed wars, drugs, terrorism, Iraq, Afghanistan and soon the rest of the world, this is a low priority issue. Funding the enforcement may be a problem in itself. Actually implementing it, might be like pulling a rabbit out of a hat, but not having the funds to buy the hat or the rabbit. Plus, you can't do it anyway, without smoke and mirrors. The banks are already overwhelmed by the Patriot Act chasing terror. Now they have normal everyday customers who may just play online poker on the weekends. Recreational bettors. They probably outnumber terrorist in our great country a million to one. The bank will be asked/forced to pour over all tractions, eft's, cc's, checks, wires, you name it. And the people they are targeting? Every day Americans. Not one of these people will be running the streets yelling Death to America, it is us.

270 days is the magic number, probably somewhat less. You have to decide before the law is implemented a course of action. There might be a huge backlash from a lot of sources. Banking, might just find out, it can't be done. Then what? If it can be done it will be like squeezing a balloon. The air just goes somewhere else. The government and the banks will always be a step or two behind the fleeter businesses. By the time it is implemented, there will be workarounds provided. So even with little effort, you and I can continue what we do. They are trying to monitor and control international commerce. Key word being international. This cannot be done. No maybes here. We can only prosecute people in our own country. We will shake our fists at the rest of the world, but a lot of people are no longer listening to Uncle Sam. He is appearing more and more like a lunatic out of control, out of touch.

The panicky will bail first. That always happens. Then? Time will tell. In a way the government is it's own worst enemy when it comes to enforcing laws they really can't. Drug prices are lower than when then when the war started. Prisons are full of low level drug dealers, and more replaced them. Availability is at an all time high, and interdiction levels a all time low. All those drug people found ways around it. The War in Iraq, huge expensive tar baby. Even Afghanistan is slipping backwards. They will undoubtedly raise their hands in triumph when stump talking, but a commoner backlash could comeback to bite them hard. You can only do so much before regular people say, enough is enough.

The religious right is slowly turning our country into a facist state. They must be repudiated before the entire game ends. They are the power brokers, not the front men who are merely puppets. All of the right wingnut religious power brokers must be stood up and straightened out. If everyone just lies down and takes this they will walk all over you until there is nothing left but them, and people afraid to stand up to them. This is the path we are on now. Why are they so powerful? Because they vote, they campaign and fund candidates. They work the political machine to perfection. In order to beat them you have to do the same. Become vocal, more importantly become heard and seen. Vote, write letters and make phone calls. They slipped this in the backdoor at the last minute when no one can do anything about it, the American way. Right wing candidate? Oppose them. Contribute against them, get them voted out. Enough of the Kyl's, Frist's and Leeches. Out.

This war can be stopped in it's tracks because it has close to no support. And it is a war on ourselves. I am not one for panic attacks or whining the game is over. They have one long fight ahead, and I will never rollover and surrender. They will take my betting priveledges away when they bust down my door and drag me off to the gambler's gulag. Until then, I fight.

Good post....and agree with you on the implementation on this. I think I read a $10 million budget was given. That'll burn up in a heartbeat.

Yep. You could not say it any better.

This is a ridiculous unenforceable law that may make for some minor inconveniences.

They have allotted $10 million to train personel, help the banks figure out how to do this, enforce it, etc.... If they allotted $10 billion, it would not be possible. $10 million will be gone before they train one bank.

as I stated before, great read frog.

Im surprised this many people are scatering over this. Like sean1 said in another thread, when the secure books starts to scatter or make any move in the wrong direction for that matter, then I will think about getting out of the offshore betting business.

Until then, take it day by day and I have a feeling when the smoke clears we will all be fine.(minus BOS clients)

Stolen your church? I'd say that it's more along the lines of the church stealing our gov't.

No more visiting ACE or his threads. That is a backburner issue. I made my points there and it is time to move on, it is like Hit says, if it is not ACE it will be someone else. Followers, I mean fools and their money soon part, and without proper money management that parting is usually pretty quick.

I am not making a panic moves, maybe drawing down some, and wait for the smoke and dust clears. This is not 1929. To be honest, no one knows what the future hold. I sure as hell don't. So I am not running around saying "What me worry?" I am treading a lot more cautiously now. But at the same time I will not run around like a chicken yelling the sky is falling.

I will be looking for guidance, from here, the books and financial institutions. I may have entire business solely located offshore. If worse case scenario comes in, I will relocate myself. The wife and I have already discussed that. But you are talking drastic, last resort measures. I seriously doubt it will come to that.

I have been doing this since the handwritten ticket days. Before offshore, before the internet, forums, neteller or anything. If I were to speculate, which is all you can do now, it will be closer to the way it was when the offshores first starting going, maybe 1998-2000. The bulk of players were sharps, and recreational bettors were afraid of the unknown. They did not come in with any numbers until a few safety years had passed. It was tough to get funds out there, and it required some leg work. What if Neteller does not exist? No biggie, it was a nice convenience, but hardly required. If any money transfer company want to surrender, I will find one that does not.

This is not like arresting the crack dealer with a rock on the corner. You are talking about everyday tax paying citizens. And countless millions of them. All recreational bettors. The books will work with you/us and keeping the show going, they always have. Every war has stages, the first shot, strategies, long and short term, adjustments and more battles. This will be a very prolonged engagement, that I know for sure. The pacifists will run and hide, no war for them, but the rest of people will keep going along until the banks stops them. And that is the kicker, they may never reach that point.

But with every war, there are sides, and sponsors. The moral majority is shoving their collective morality up my ass. I hate that. Just leave me the hell alone and let me do my deal, that is what America was founded on. Not religious zealots deciding what I should and should not do. Good thing is, they talk a lot, but hardly ever walk the walk. So far a ton of talk and posturing. Arresting a couple of clowns before the law was passed, before the elections. Nothing is going to happen soon, especially with elections coming up. Then, after that statement is made, if current power brokers are set back, their ambitious plans to take away my vocation may come to a grinding halt.

I would and will write my congressmen, if they voted for this in the house, or the senate. In no uncertain terms I will vote for whoever opposes you, in every election forever. I will also tell everyone of my friends, and tell them to tell their friends. I do not care if the candidate running against you is Sponge Bob Square Pants. I will vote agiainst your entire party if I have to, even change parties. That is language these people understand. I am just about done getting sodomized and trampled under foot. Time to dump the denial and realize we are now at war. The war on gambling will not be won. It is not about who is right and wrong, but who can win.

The first or Frist shot was fired. I am not exactly thrilled a war was started, but it has been declared. Now let them try and win it, I don't think they can. I would rather keep fighting then throwing in the towel. I will support my books, the financial companies that stick it out, and the candidates that pushed this through. The bill's sponsor for letting it be attached. The right religious facists. All of them.

The next few weeks will be very telling how the war might go. Please share all and any pertintent information with the board. Anything and everything. Work together and fight together. I will reiterate one very strong belief, this will be a prolonged battle.

Great post Omnivorous. Here is my question and I was wondering your thoughts or anyone else's educated opinion.

If for some reason this law does actually come through and make it more difficult to deposit through Neteller, etc. Then wouldn't it be easy for the books like Pinn, Olympic, etc. to have us just mail a money order, etc. or even deposit on Neteller to an individual person (middle man) and that person is directly connected to the books? Then for payout, we receive the payout or personal check in the name of that person and that would clear since it's not directly from a sports book?

I wish I could answer that but that will be much deeper in the game. Of course workarounds will be made available. And if Neteller bows out, there will be some other company with cahonies that will take over the cash cow in a heartbeat. But all things in order. And that is way down the line. It is also presumptuous that everything goes ideally as planned. I am very skeptical anything will go as planned. In fact, I do not even know if this is just a moral victory the right wingers wanted before the election to show us they don't suck. Well, they showed me they do suck. Attaching the truncated toothless version can be claimed a victory, but after that, who knows. It could vary widely. From very successful requiring workarounds, to an abysmal failure, like what happened when they tried to prosecute the computer group. After the elections and chump stumping we will see if it was a political execise or a real agenda. Then we take it from there.

I'm quite sure they'll come up with a few new methods to get around this law if it is in fact enforced. It doesn't take much but maybe the I.Q. of a lab rat to get around the fools in Washington.
