NYC: Gambling Web Site Brings 24 Charges

NEW YORK (AP) -- Criminal charges have been brought against more than two dozen individuals and corporations in four states in connection with a billion-dollar-a-year gambling Web site, authorities said Wednesday.

Authorities declined to name any of those charged. One of the corporations is an offshore Internet company with an American counterpart, said Kevin Ryan, a spokesman for Queens District Attorney Richard Brown.

Ryan said the case is "one of the first times that a Web designer corporation and the companies that maintain the Web sites have been charged."

Police said the arrests were made in New York, New Jersey, Florida and Nevada. The scheme involved placing sports bets through bookies via a secure Internet site.

Ryan said the arrests by the DA's office and the New York Police Department represent the first time that Internet gambling charges have been brought since President Bush signed into law last month the Unlawful Internet Gambling Enforcement Act.

Ryan said arrests had been made in four states, and "we have initiated a $500 million asset forfeiture case," one of the largest in state history.

The charges come after a two-year international investigation that focused on Internet gambling.

Brown and Police Commissioner Raymond Kelly scheduled a midday news conference, at which seized cash and assets - including artwork, jewelry, gold coins and sports memorabilia - were to be displayed.

what worries me about betting online is you have a solid paper trail, a slam dunk for any prosecutor who wants to enforce this law .

Was this site based out of NYC? If so I can see why they are busting it...if it is a foreign based book I can't see how they can charge anyone since its not illegal to place a wager

Just because Bush signed the law, does that means it's already in effect? I know new laws usually go into effect with the beginning of the new fiscal year. I also know the federal fiscal year began October 1, but there have other posts here, that said it would take 270 days to enforce. Anyone know what's right?

more than likely they were using agents inside ny state to settle up.

There is no law against placing a bet in New York. You will not find any statute in their criminal code.

There is no Federal law against placing a bet in any state.

Most likely local bookmakers using a call center offshore for their players to either call in their bets or place them online.

This case really has nothing to do with new Internet Gambling Enforcement Act, the arrests are the result of a two year investigation.

exactly, this kind of thing has been prosecuted from time to time over the last decade...

Sorry to bust some bubbles, but I believe the feds can "adopt" any state criminal code violation and prosecute it in federal court under federal interstate commerce statutes. Thus, if it is a crime to place a bet in your particular state (and I believe thats just about every state except Nevada), the feds can go after you as if they were in state court. :realtongu

Actually most states have no laws against placing bets as opposed to being in the betting business.

Furthermore, I don't believe the Feds are empowered to federally criminalize state laws when they see fit.

Just wondering if anyone has any idea as to what site was busted?

I mean from the article it seems as though it was an operation that used local agents to do the collecting?
