Cisco Sues Apple Over Use of IPhone Name

SAN FRANCISCO (AP) -- Cisco Systems Inc. said Wednesday it is suing Apple Inc. in federal court over Apple's use of Cisco's registered iPhone trademark for its new handheld device.

Cisco has owned the trademark on the name "iPhone" since 2000, when it acquired InfoGear Technology Corp., which originally registered the name.

And three weeks ago, Cisco's Linksys division put the trademark to use, releasing an Internet-enabled phone called "iPhone" that uses the increasingly popular Voice over Internet Protocol, or VoIP.

On Tuesday, Apple unveiled the iPhone, its "game-changing" touch- screen-controlled cell phone device that plays music, surfs the Web and delivers voicemail and e-mail.

"Cisco entered into negotiations with Apple in good faith after Apple repeatedly asked permission to use Cisco's iPhone name," said Mark Chandler, Cisco senior vice president and general counsel, in a statement. "There is no doubt that Apple's new phone is very exciting, but they should not be using our trademark without our permission."

Cisco is seeking injunctive relief to prevent Apple from copying Cisco's iPhone trademark.

"Today's iPhone is not tomorrow's iPhone. The potential for convergence of the home phone, cell phone, work phone and PC is limitless, which is why it is so important for us to protect our brand," Chandler added.

Yeah, Cisco is all over them. Wouldn't someone at Apple check to make sure the name was available?

Apple has been negotiating with Cisco over the name for the last 2 years.

Very odd that they would go ahead & take it to market....wtf?

And the reality slowly sets in about what the iPhone is and is not. Noted analyst and Engadget pal Michael Gartenberg stated that the iPhone is first party software ONLY -- i.e. not a smartphone by conventional terms, being that a smartphone is a platform device that allows software to be installed. That means hungry power-users -- you know, those people ready and willing to plunk down $600 for an 8GB musicphone -- won't be able to extend the functionality of their phone any more than Apple (but thankfully not Cingular) dictates. Other unfortunate realities about the device:

  • No 3G. We know you know, but still, it hurts man.
  • No over the air iTunes Store downloads or WiFi syncing to your host machine.
  • No expandable memory.
  • No removable battery.
  • No Exchange or Office support.

I would buy one if they got rid of some of the garbage. I don't need a MP3 player. I don't need a camera. And I don't need any bluetooth bullshit.
Just give me a device I can take and place calls with and also browse the internet.

Those already exist, and Apple wants to put their spin on it.

Surprised more computer companies don't jump in the phone market.

Odds Given on iPhone Failure

When the long-awaited iPhone hits store shelves this week, no doubt many Apple enthusiasts will adopt early as they've done in the past with other products from the company. But just how crazy it gets is anyone's bet.

In fact, BetUS.com figures the odds are 20-1 that someone will get trampled while scrambling to snag one June 29. The site has also put odds on how long the batteries will last and whether the devices will be recalled.

The idea for creating these odds and a host of others surrounding the iPhone was spurred by past electronic firsts that have been greeted with enthusiasm but also a slew of unrealized defects and bugs.

"This phone has everything but the kitchen sink,” said BetUS.com spokesman Reed Richards. “With the seemingly endless options that the phone offers, the chances for a malfunction are likely.”

The device combines a web browser, music player and mobile phone into Apple’s characteristic sleek package.

Will iPhone live up to the expectations of today’s tech-savvy consumers? Here’s what BetUS.com is betting:

* Consumers are reported camping out waiting for an iPhone—3/1
* Initial iPhones get recalled—30/1
* iPhone sells at least 12 Million units in 2008—5/6
* Apple’s stock jumps at least 10% in value in regards to the price on 6/30/07—1/2
* Consumers pay at least three times the original price ($1,500) on ebay—2/1
* The screen breaks/cracks like Apple’s first-generation nano (iPod)—150/1
* There are mass reports of the battery life being less than the promised 8 hours—10/1
* Someone is trampled while trying to get an iPhone—20/1
* iPhone spontaneously combusts—150/1

Why would you buy an iPhone if all you want is phone and internet? There are already plenty of those out there. The whole appeal of the iPhone is that it is the (allegedly) best combination of mp3 player, phone, camera, internet that is on the market. If you don't want all of those things in one, there are already plenty of devices that suit you.

I'm gonna buy a HTC S710 tomorrow, which does a similar thing, but with a keyboard (QWERTY) rather than touchscreen for better internet browsing

i've read they should releaase the 3rd generation iphone around oct 07, may want to wait until the bugs are worked out on this baby before dropping a nickel on a phone, those that do purchase please advise us as to how it goes.

its not even a smartphone, so you cant add on memory and programs

and its not GPS enabled

only thing it has thats unique is ability to play flash ( youtube movies)

otherwise Treo much better still
