MADISON, Wis. -- A River Hills man can't deduct his gambling losses from his Wisconsin taxes, a state appeals court ruled Tuesday.

The 1st District Court of Appeals ruled a state law that went into effect in 2000 prevents gamblers from counting losses against their winnings.

According to court documents, Daniel Dettwiler claimed about $100,000 in income from gambling on his 2002 state taxes. He also claimed $41,637 in gambling losses and deducted them from his winnings.

Dettwiler contended that federal tax codes permit him to subtract the losses from his income, and the federal codes are the starting point for determining his income for his state taxes.

The state Tax Appeals Commission disagreed, ruling his gambling losses didn't qualify as deductions. The appeals court said Dettwiler's arguments were "wholly contrary" to the Legislature's decision to eliminate such offsets with the 2000 law.

I don't believe this includes people who file schedule Cs... Just personal deductions. WI would have no way to know what is on a scheudle C

you can claim losses against wins if you consider them all one bet. It really depends on whether you do your accounting daily, weekly, or monthly.

Well, if you hit "signers" in any of the many Indian casinos they have in the state, or hit a nice trifecta in an OTB, they have records of it.
No way in hell do you claim off-shore winnings.

Weird as they have dog tracks in Widky (as well as indian casino's). If you go to the track or casino everyday the winning can add up. I know the state tax is prob only 3% or so but to some it can be a few grand to some, they shouldn't have to pay even after maybe being a net-loser.

Wisconsin is a sh**hole for gamblers with this law. If you like to gamble, get the hell out of Wisconsin!

Why wouldn't they? most states require a copy of you federal return including schedules when you file your state return.
