I got assaulted like 10 days ago, Should I sue?

Heres the story,

Was up at a party at my college, my friend was getting held in like a full nelson or some shit, so I go up to the dude and was like what the fuck you doing and such, before I know it, I have a broken nose. I wasn't expecting it, so it was a clean shot. I got my couple shots on him in, but he got his first and only and was the best of the fight. He broke my nose in a couple different places and messed it up inside. I just had surgery done on Thursday to reconstruct the inside of my nasal passages. I am still hurting and I pressed charges a couple days after this happened(the fight). I just got the court hearing in the mail today...But I most likely wont be able to finish this semester of school because of this and my medical bills and such, pain and suffering. ect.

I have a pretty good lawyer who is my cousin. He told me that it might be hard if he doesn't have a lot of money but hes looking into it.

Anyone have any advice?

If you need more details about anything, just ask...kind of threw this together quick.

Yea man, its pretty tough...been on 2 vikes every 4 hours since thursday. Pain finally subsiding a little.

Not really sure about the medical bills but I mean they have to be a shit load for surgery, I know I was up to about $500 before the surgery just from the ER and specialist visits and such.

maybe you should ask the girls over at the battered womens shelter what your best course of action should be???

but seriously, man up... you wanted to save your buddy, and it sounds like you did... you can't claim you didn't expect the guy to come at you... next time you go to break up a fight my advice is to expect the guy to come at you...

Sounds like you are already suing. The fact that you threw punches as well in retailiation hurts your position. Your cousin the lawyer should be able to provide you with better counsel than anyone in this message board.

I was going to "man up", until I had have the surgery.

Was on campus. Officer filed the police report and everything. Took pictures of my face the night of the fight and a couple days later.

The letter I just got, is for a preliminary hearing(not really sure what that means).

Still got two black eyes?

On New Years Eve I got my nose broke in a fight. Guy blind sided me when I was fighting someone else. He got like a 5 step running start and just layed into me. When I went to the bathroom my nose was on my right side of my face. I cracked it back into place, nothing hurts worse than a broken nose! Had two black eyes for like 2 weeks afterwards.

-I don't know about sueing, depends on what kind of bills you are going to have.

Doesn't that fit into self protection in any way.

I also have about 10 witnesses(if that matters).

Weak IMO to sue someone if you took the first shots. Won't hold up in court.

you sound like a ***** to me. I always hate guys that want to act tough in bars or at parties (i know you were defending your friend but if you want to get in the mix you have to understand you might get hit simple fact) then when the shit goes down they want to sue if they get hurt a little just be a man and go on with your life . hope your nose heals :toast:

was your freind fighting 1 on 1? stay out of it you approached the guy saying what the fuck is going on you had an attitude that was acting tough if you dont want to put yourself in those situations in bars or parties keep your mouth shut. im sorry your nose was broken shit happens its just makes me sick every tough guy that asks for it wants to sue afterwards but thats the world we live in i guess

well, it's gonna be a weak case on your part... you and your buddy against this guy...

he is gonna claim he was outnumbered, felt his life was at risk, had to fight like his life depended on it.

you on the other hand will have to prove that you and your buddy didn't want to fight this one guy and you both were doing everything in your power to avoid a fight.

You approached the guy...so no you shouldnt sue. Just chalk this one up to being young and dumb ( No offense). If the guy attacked you w/ out reason then you would have a case.....jmo

Basically, after he hit me it was pretty crazy. I don't really remember every detail after I got hit other than mass comotion.

Like I said, I can deal with a black eye or even a broken nose that doesn't involve operation.

I forgot to add::

This guy that hit me left the party and followed a random person back to his apartment and knocked on his door until this guy came out and then hit him and knocked him out. This dude just thinks hes a hardass punk, I wouldn't mind taking a few bucks off. He was arrested before the cops even knew about me(from the other guy)
