Ok, here's the story:
Last week my brother got rear-ended. He stopped at a crosswalk on a road for a handicapped lady waiting to cross by with her two dogs. There's a visible red stop sign on the side stating "Stop for pedestrians". The guy behind him was apparently tailing him very close, possibly 5-10 miles over the speed limit, wasn't paying attention on the road, and rear ended my brother pretty badly. My bro's 2006 Honda Accord got totaled as a result.
Thankfully everyone on both parties didn't get seriously injured.
Now, the fuc.ked up thing about all this is that the other driver was driving with a Mexican license, doesn't speak one word of English (not being racist here, it's just frustration due to lack of communication in such situations where you need to communicate well), and has insurance with a firm based out-state in California.
The insurance agent for this company told my bro that their client's maximum payout coverage for a collision is only 10K. Now, my brother's Honda Accord which got totaled, and which he bought brand new in '06 is itself worth about 15-16K. In addition, there may be additional medical expenses (checkup, physical therapy, etc) in the future. I think it's just plain fu.cked up that my bro will only get a check for 10K.
I'd appreciate it if any of you who went through similar situations in the past, or any of you who are able to give legal advice on such matter can help.
