Seeking legal advice regarding a car accident. Any help appreciated....

Ok, here's the story:

Last week my brother got rear-ended. He stopped at a crosswalk on a road for a handicapped lady waiting to cross by with her two dogs. There's a visible red stop sign on the side stating "Stop for pedestrians". The guy behind him was apparently tailing him very close, possibly 5-10 miles over the speed limit, wasn't paying attention on the road, and rear ended my brother pretty badly. My bro's 2006 Honda Accord got totaled as a result.

Thankfully everyone on both parties didn't get seriously injured.

Now, the fuc.ked up thing about all this is that the other driver was driving with a Mexican license, doesn't speak one word of English (not being racist here, it's just frustration due to lack of communication in such situations where you need to communicate well), and has insurance with a firm based out-state in California.

The insurance agent for this company told my bro that their client's maximum payout coverage for a collision is only 10K. Now, my brother's Honda Accord which got totaled, and which he bought brand new in '06 is itself worth about 15-16K. In addition, there may be additional medical expenses (checkup, physical therapy, etc) in the future. I think it's just plain fu.cked up that my bro will only get a check for 10K.

I'd appreciate it if any of you who went through similar situations in the past, or any of you who are able to give legal advice on such matter can help.

He's actually lucky that it's $10K and not $5K (CA minimum for property damage), which is what most people carry in CA. But this does not mean he can't collect for medical expenses, which is a seperate coverage.

He needs to hire a lawyer. They all do it on a contingency basis, which means he doesn't have to pay upfront. They'll have him start seeing a chiropractor for couple of months. Then they can use this to collect medical & pain/suffering/lost wages.

My car was also totalled in an accident (airbags deployed) and they ended up settling for $15000 ($3000 for the car). But it lasted over 2 years in litigation due to the guilty party dissapearing in to thin air. Funny thing is he called the police that day and their accident report did him in, so he just took off.

Minimum coverage in CA is 15/30/5.... $15k bodily injury to 1 person/$30k bodily injury in 1 accident/$5k property damage.

sounds like the insurance level is below mandatory minimums, I don't think the coverage can be that low anywhere in US.

It's evident that you don't know jack shi.t. Read my post again. I said I'm seeking help from those who went through similar situations. It doesn't take a brain surgeon to know that insurance companies are a pain in da ass.

Wow, 5K in Cali is the minimum? Damn that's low. My brother is actually in the process of getting a lawyer. Thanks for the input Crunch.
