Looking for some legal contract help.

Been asked by someone to help them come up with a contract for a new employee (cook). He is training him to work in the kitchen and basically will be teaching him everything including how they prepare the food and the homemade sauces. He doesn't want the guy to work there a year and go to a competitor (another Japanese restaurant) whether he quits or gets fired. If he does work for five years, he says it's okay for him to work for another Japanese restaurant if he quits/fired.

I've done some Google searching but I'm far from knowledgeable about legal stuff. This sounds like a non-compete clause. I know businesses do have it in employee contracts.

Anyone can help me find a form online? Also what should the penatly be if he quits or is fired and is found to be working for a local competitor? Should it say that he can't work for a competitor for a number of years after he leaves the restaurant?

I just need to be able to type it up and have the guy sign it I suppose. If there is a website where I can download a free employment contract with a non-compete clause in it that would be great.

pay an attorney to do it, shouldn't take more than an hour or two. You have to be careful w/ non-competes, they aren't enforceable in every state and each state has its own specific limitations as to what makes it enforceable. You should at least talk with an employment attorney from FL to get an idea about it.

Generally speaking, forms you download from online sites are shit.

thanks fhmesq for the quick reply. I'm thinking that I should tell him that too because if I write somthing for him, I'm sure i'll screw up the language.

You need to put a non complete clause in his cotract...I have one for a business deal i just finished.....Email me if interested...G.
