Question about finding money at ATM....

Just talked to a buddy of mine who went to the drive up ATM and when he pulled up he found $200 in cash still in the machine. He took the cash and then hit the button to have the card returned. He pocketed the cash and put the card on top of the machine and then he put his card in and made his transaction (deposit).....

My thoughts are that he is going to get caught....

I think that if he would not have made his transaction his chances of not getting caught would have been better, but still may have been caught.

I told him he should take it to the bank and turn it in, but it just not happening.

If he is caught, can he be prosecuted?

Maybe your friend left out the first part of the story when he knocked the poor sap over the head first.

No way will he get prosecuted. The person who left his card in the machine will feel way too stupid to do anything about it.

lol, he won't get in trouble for this. but i believe IF he were going to, it wouldn't have to do with the picture of his face, but the fact he used the machine himself immediatly after

The bank is going to send out snipers. My advice, don't hang out with your friend for a while.

He shoulda acted like he didn't see the cash, then done his transaction and taken the wad. At least if he does get caught, he can say he didn't notice it. :)

Your friend will be in the movies for certain and most likely it will show him taking the cash and pocketing it, then using his card for a transaction (on same tape) so he should at least expect a letter from the bank and maybe even having his account frozen. Real criminal proceedings are very doubtful. Youtube would love to get their hands on that recording, it would make a big hit on the www.

Bottom line - dumb thing to do in any case, basically he robbed the bank, very unsmart.

He didn't rob the bank, the money was taken out of the other guy's account. He's an idiot for using his own card after taking the cash though.

This story sounds suspect. How could you possibly walk away from the ATM without your card or the cash??

most places have laws on the books that state that if you find something of value (over certain amt) it must be turned in to the police, if not claimed in 30 (or 60 or 90) days it's yours to keep.

1. your bro is on tape taking it
2. your bro most likely broke the law by not turning it in
3. the person that lost the $200 is gonna end up being some old women
4. local news is gonna show that tape of your bro taking that money @ 5pm, 6pm, 10pm and 11pm and will follow up with an interview with the pissed off family

Let's do a twist here. What if the money is found on the concrete/asphalt next to the ATM machine that is going to be floated away by wind or such? And there's nobody around because it's after banking hours?

Now what? Is this the same as finding $20 on a sidewalk (or $200)?

*Never mind* I see that the buddy of the OP ALSO TOOK the card out of the machine after it was left INSIDE the machine. That story is even more weird because most banks would not spit out the card after idle of a minute or something. It happened to me before when I drove away and forgot my ATM card (but i took the cash & receipt instead, lol). I returned but it was inside the machine so I had to return back the next day to pick up my ATM card from the branch.

Yeah, that doesn't make any sense about him taking the card out.

I've had my card eaten by an ATM when I accidently forgot to grab it, and being furious learned that most every ATM sucks in cards and destroys them if you leave them in for even just a 45 seconds-1 minute.

He must have seen the lady just drive away/walk away and taken the cash.

Also, I can understand somebody leaving the ATM or the cash, but both? Usually it's one or the other. Must have been on drugs/drunk/very old. In that case, might never find out they even took 200 out and your "friend" is in the clear.

the guy leaves I walk up there look at the screen and he had walked off with his accounts still on the screen with do you wish another transaction Y/N.

I thought Ill just end the thing for him as nothing to gain and everything to lose over withdrawing from someones account with cameras all round.

just not worth it imo

had the exact thing happen to me at colleg. had to run after the guy to give it back to him, and he wasn't even drunk yet.

I hope you are joking...obviously the bank will know....it may be a little gray whether he would actually be considered to have committed a crime but the bank will realize who took the money.
