Just came back from the gym and my trainer asked me some questions i just couldn't answer with any certainty. It seems he moved here six months ago and bought a house that needed some repairing. he moved in and made a agreement with a contractor that would do the work. The contractor told him it would be 31,000 dollars and would take two weeks. Sam told him he would pay him 21,000 dollars when he got almost through and the balance when it was completed. The contractor said he couldn't go any farther as the rest was something he wasn't qualified to do. Sam said fine i will find someone else and paid him his 21,000. Yesterday someone came to the door and said the contractor owed him 8,000 and if Sam didn't pay him he was going to put a lein on the property. I told him to tell the guy to take a hike or or kick his ass off the front porch. I also told him his agreement was with the original contractor and not some subcontractor. The guy said he had been doing most of the work and Sam said i have never seen him in my life however i can't say he didn't do the work.Does he have a legal leg to stand on? hola

I'm not a lawyer but I play one in real life. No seriously though, is there a written contract? I would think with this kind of money being spent there would be something on paper. If this story happened exactly as you typed it then it sounds like the 1st contractor might be a crook. As always though, I am willing to bet there is much more to this than is being told to you. Sounds like an attorney might be needed.

Ask FHM ESQ he is a lawyer.

i would say the contract was with the first guy only and if this tough guy schmuck wants his money he can sue the first guy....

that is a problem.

always, always, always run any type of construction or remodeling on a home through a title company. they make sure everyone gets paid and there are no liens.

this kinda thing happens every day and its the home owner who gets screwed

Don't waste your money hiring a Lawyer until your sued. The guy can not put a lien on the work. First question out of the judges mouth will be, show me the contract the client signed. Most states with that large of job requires a written contract.

Not true, many states provide contractors with mechanics' lien rights that allow them to lien the property if they aren't paid.

I used to put mechanics liens on properties in WV and Maryland when I could not collect on my floor covering business. The threat of the lien usually got me paid, but a few times I had to go the longer route

Contractor lein

This happened in Texas and i do think there is a lein that can be put on an unpaid bill , however i just can't imagine how if the bill was paid and sighned , someone could just come up and demand money. I feel for the guy because he just got married and i know this took all of his saving's and in hiring a lawyer there goes another three or four grand.What would keep anybody from saying i did some work and you owe me.? I'm going to see him tomorrow morning and i will ask if a contract was sighned , what it said. I do feel like he is being honest with me because he is as square as they come and a super nice guy. That is not much of a character reference, but i've bet on less.This sounds to me like a backdoor scam through the original contractor.

Who came to your house demanding payment, the general or sub? Did you get a receipt for payment from the general?

He had already paid the main contractor and never laid eyes on this guy until he came to the door yesterday. He told him he had been doing most of the work and the main contractor owed him and had not paid. Sam said i have a receipt for paying the contractor, but the sub wasn't satisfied with that explanation and said he was going to put lein on theproperty. I would sure think the idiot had no case at all.Boy, it's a damn shame with what people can get away with sometimes.

it depends on the state that the work was performed.. I'm not a lawyer but have my real estate salesperson license...
FYI.. any lawyer can work as a real estate broker.. so they any attorney should be able to address this problem.
