This happened to me way back in the early 90's. I was in my early 20s. It was New Year's Eve. Around 1am I was driving me and my buddy back from a party. We were on the freeway and for some reason I took an off ramp I was not familiar with. Was going way too fast and went up into the grass, spun around and slammed some street sign down with the side of my pickup as we came to an unceremonious stop. We were both going "whoa, ah shit how did that happen" when I looked around and saw a police car about a block away. Copper turns on his car and starts our way. I can't even remember what was going through my head at the time, but I am sure I was not looking forward to a chat with Johnny law.

I told the cop I had a few drinks hours ago and that would be the reason I might smell of alcohol. "Oh yeah, I stopped around 9." The truth was more like a half hour ago I finished my final beer and bowl. Cop had me recite the alphabet and do the touch the nose routine. He talked with the other cop and said something like, "yeah, he's done some drinking but I don't think he's over the limit." I guess the cop didn't have a breathalyzer with him, or I think I would have been nailed. He tells me the state will be sending me a bill for the sign and that I need to slow down and be careful. I said, "yes sir," and was on my way.
I had a ding on my truck but I was one happy driver on my way home again. That made my record go to 2-0.
Have never had the misfortune of taking another test since then. I know the coppers aka tax collectors are not so casual about DUI nowadays.

Port Richey, Florida -- Joseph Errichiello is trying to walk a straight line but he is having trouble, just like he did when he was arrested for DUI on September 1<sup>st</sup>.
Errichiello says they asked him if he'd been drinking again and he said no. He says they told him he was under arrest for suspicion of DUI.
Errichiello who was pulled over by the Florida Highway patrol in a DUI checkpoint failed all the field sobriety tests on his lack of coordination and the mental agility test.
Errichiello says he has had a learning disability that he's had since a kid.
The trooper didn't buy Errichiello's story and after he was arrested Errichiello who says he doesn't drink voluntarily took a breathalyzer test it came back 0.00.
He says they asked him if he would take a urine sample which would prove their case and he said he had nothing to hide so he said no problem.
Despite the fact that Errichiello blew 0.00 on the breathalyzer test and the Florida Highway Patrol confirms he had a 0.00 on the urinalysis the State Attorney's Office is still prosecuting him for DUI and he can't understand why.
Errichiello says that the system in Pasco is wrong because he did nothing wrong. Then he got arrested again. 12 days later the Pasco Sheriff's office pulled him over for the exact same thing
Once again the breathalyzer and urine analysis came back as 0.00. In the second case the state attorney is dropping the charges and says once it receives the paper on the urinalysis in the first case it will do the same.
But the incident is a sobering thought for the man whose mental and physical disabilities make it impossible for him to pass a field sobriety test even when he hasn't had a drink or ingested a drug.

If the cop is cool he'll let you go... City cops are cool if you're white and not in the wrong neighborhood. if you have a nice car, suburban cops won't roll you as much.

Sobriety tests are impossible to pass, the pen eye thing and standing on one leg with your eyes closes..

NEVER BLOW.. state your name and give him your ID

Don't be to proud of it boyos.I just lost a freind killed by a drunk driver in upstate NY this week.Himself being sober for about 15 years.
I've gotten away with it more times than i can count including beating it after an arrest and going to court back in the day....no more.
Be cool.Be careful. You don't want to be pulling a tricycle out of your car grill some day.

I beat it twice. I had a few beers and smoked a doobie before leaving from my friend's house late at night to my parents house where I was staying. Turns out I crossed over the white line between lanes and I got pulled over. I popped some M&M's in my mouth (I had heard those fool the breathalyzer).

I did all the stupidity tests and blew in the breathalyzer except that I made sure I spit in it thinking that would dilute the test. I blew a 0.09. The cop got mad at me for spitting and asked me to blow again. I blew a 0.11. Since the 0.09 could have been the correct one and the law at the time was 0.10 the cop knew he couldn't win in court so he told me "I want you to remember how drunk you are right now because this is the limit of driving while intoxicated".

A second time I was on vacation. I wanted to go out on a week night just to know how things were so I drug a buddy along. I was drinking a few beers and realized I was getting near drunk so I switched to club soda for the last 2 drinks. I decided to go home and drove away from the bar.

A cop pulled me over. When I asked him why he pulled me over he said I was "swerving within my lane". So I did the stupidity tests and blew in the breathalyzer and blew a 0.08 which was legal at the time. The cop then said, "do you want to walk or do you want a cab"? I told him I was legal to drive so I was going to drive. The cop then said, "I'm not going to let you drive. Neither one of us would feel very good if you ran into someone tonight". So I had him call me a cab.

The cab took me near my home and told me I should just go back and drive my car home. So he took me to my car and I drove home. Stupid cop.

The lesson learned here is that you should never do the stupidity tests. You are not legally required to do so and it can't be held against you if you refuse.

Reciting the alphabet backwards.

Saying the alphabet backwards is not that easy sober if you are talking about rattling it off like a kid in 4th grade does when reciting his ABCs the normal way instead of backwards.

Try it sober, I can do it but have to think about what comes next at several points along the way. Maybe it's just me, I am not sure.

On the other hand I can name all 50 states and their capitols likkitee split like no one's business.

I have never tried to recite the alphabet backwards drunk because I have never had to.

I took the field test in front of 5 cop cars with headlights directly on me and like 8 cops. The original cop didn't want to let me go, but the others were like, "he is passing every test". I was lucky though because I normally drank a lot when I was playing pool.

That's how I was pulled over the 2nd time. Cop followed me out of the bar and pulled me over "for weaving within my lane". Pure bullshit. He should have followed someone who was exhibiting REAL behavior of being drunk like crossing over the line. I wonder how many drunks got away because he was spending time pulling me over.

Remember, you don't have to recite the alphabet or do any of the other retard tests. Don't give the police any added information that can be used against you in court.

In Mass, it's 90 days. At least that's what it was in 1985 when I was asked to reconsider my decision not to submit to one.

I got pulled over and prayed to God to help me, next thing I know the cop is telling me how lucky I am because he's been called to a different crime scene lol.

Hmm, I was drunk and it was the size of a pencil and both cops were women so maybe it was nipples I was nibblin' on.

I think most states are like that. But my point is so what. You will lose your license anyway for the DUI. This way you can avoid the DUI conviction on your record. Stupid yes but these are the risks you take if you choose to drink and drive.

Why admit guilt when you can go to court and get it reduced? Could mean fewer points on your record, a misdemeanor over a potential felony,
