Any divorce lawyers here that could answer this?

My daughter recently walked in on her hubby banging another woman and a week later she was served with divorce papers. He has a lawyer and has scheduled a hearing for this Friday for a temporary order. She was served a week ago so she has 12 days till this hearing. He is asking for joint legal and physical custody and doesnt want to pay any child support. He makes nearly 3 times as her. They are basically splitting the time with the kids however now as they work opposite shifts and need to do that. Can she get this hearing postponed without a lawyer or can she just go by herself and tell the judge she hasn't gotten one yet and needs more time and can she go after child support even though she agrees to joint physical custody seeing he makes so much more then her?
I would greatly appreciate any advice on this matter. She is devastated by this and isn't moving on it like she should. Am trying to help but i have a shitload going on in my own life at present. Thanks very much.

I'm an attorney - FIRST THINGS FIRST - GET AN ATTORNEY - this guy wants to play hard ball - that's life - not time to feel sorry - time to put on some gloves

Second, he does not want to pay child suport - that's great - I want my **** to grow 6 inches tonight - he has no choice - the court will order child support unless she is a billionare - and if he does not pay it he goes to jail

Quit fvcking around and get a divorce attorney - don't show up at the hearing wiitout one

Being that she saw him committing adultry she can nail him to the cross. The judge will grant a continuance if she asks so she can seek counsel. She will have plenty of grounds for child support, medical costs, and even child care if she does not want to give him legal custody.

Nice Seymour but just remember not everyone goes to jail. My step sons dad owes about $7,000 to my wife, he has not paid shit for some time, well let me rephrase that he pays when he feels the need, maybe once every 4 months, $100.00, he works under the table to avoid wage attachement and the county he lives in is overcrowded with dead beat dads.

OK, but is is very likely someone who does not pay court ordered child support will end up in jail - especially, when this guy has the money.

Has your wife ever pressed the lack of payment with the court? I understand it costs money to go to court an chasing around broke people is a waste of time jsut curious.

Yeah we went and believe it or not the judge was a complete ass to my wife. The ex pulled the I dont work shit, in reality he works under the table as a plumber by trade. Its not worth the shit of hiring a pi to follow him around for money that for the past 15 years has not made shit of a difference. When he was born he was required to pay $25.00 a week. he would not pay. Seymour when I tell you the arrears built up was built up over time of not paying simple shit like 25.00 a weeek to eventually what it is now 70.00 a week. Deadbeat pure and simple. But the judge said basically he gave her what was called a strict probabtion which put him on status if he missed 3 payments a warrant would be issued. Well he missed three payments and a warrant was never issued. When it was brought up in court he said that he could not put him in jail or make him pay if he is not working, what a joke. But I do agree with everything you say. I will also agree with you, a guy like that who has cash and can pay or should i say can show the means of paying will more than likey be picking up the soap on a rope for a while.

She is in Michigan a no-fault divorce state. She is going to have to agree to the joint physical custody because they both need the other to watch the kids while they work opposite shifts. My concern is will she still be able to get child support while agreeing to the joint physical custody or because they have them 50/50 is no support automatically happen?

I don't know MI law - but I am 110% certain that the kids will get child support - did she smarten up and get an attorney yet?

She will get child support unless he gets custody of the kids. She will then pay him child support if that happens. Due to the fact he was caught in bed by her screwing around it appears likely she will get custody.

Any divorce lawyers here that could answer this?
