A Sioux Falls man this morning was sentenced to 90 days in jail for a sex act with his high school girlfriend.
Joseph Rehema, 20, pleaded guilty in October to fourth-degree rape, admitting to a sex act with his girlfriend when she was a 15-year-old high school freshman. Rehema was 19 and a senior when they began dating.
Deputy Minnehaha County state’s attorney Colleen Moran said Rehema has shown no remorse since his arrest.
“He has shown concern for how it has affected him getting in trouble for it rather than how it might have affected the victim and her family,” she said.
Defense lawyer Darren Magee said Rehema’s is one of the few cases that merits a suspended imposition, where the conviction isn’t entered as long as the defendant complies with probation.
“This is the type of case that just shouldn’t ruin a young man’s life,” he said. “Joseph is certainly not a sexual predator.”
Judge Glen Severson instead stayed a five-year prison sentence for two years probation and 90 days in jail. The judge said he might consider changing the sentence to a suspended imposition if Rehema succeeds with probation.
The statutory rape conviction requires Rehema to register as a sex offender, but he is allowed to petition for removal after 10 years.
