Police sieze your computer, do you get it back?

Alright I was arrested right before Christmas... long story short a lifelong friend of mine who was busted for growing weed and selling set me up and had me order lots of hash from overseas for a narc.

After turning my room upside down they took both of my computers. I communicated via email with the source overseas.

My question is will they just destroy the computers once they don't find anything on the hard drives or will I eventually get it back?

if no charges are filed you should get them back in 2 years. If they are filed you will never get them back

most likely i will be put on probation... no jail time since its my first offense.

one was a brand new macbook... sons of bitches. and i know they dude who was the head investigator and this guy is on steroids which pisses me off even more.

Yes you will get them back. According to the law, as long as they dont prove they were purchased with stolen/illegal funds, they will have to return them. You could be forced to pay the cost of them retaining the information off the hard drive. Your attorney will have to file a motion to compel the return of property. Depending on what course your case takes it could be a while before you actually see them. If they dont find any data on them which they need, you can get them back fairly quickly.

I disagree wholeheartedly.

I hope he posts a follow up. I have family in the business and this is not the case. If the computers can be proven to be PURCHASED with ILLEGAL money...THEN...he will not get them back...but they have to prove this...they can't just say "You were talking to someone overseas about drugs, you dont get them back"

Doesn't work that way.

No chance now a days. Seizures are the new thing. Everything they can seize they sell and the money goes back to the department. A bunch of new laws to help Law Enforcement get money to fund overtime and aloow for more raids and enforcement. In the big cities are cutting back on tax dollars going to police so they have to look else where for funds and this is the new way to get funds.. If your are found guilty or plea no way in hell you got a chance to get it back. Just order some more hash and sell it and buy another one like all the other drug dealers do.

I am not a drug dealer. I got into this shit because this "friend" of mine knew I had a connect overseas (which I used for personal use)... I would recieve usually an ounce each order for myself... but he knew I could get as much as I wanted. I was dumb and gave in. That was the only deal I ever made.

Going to just eat my losses and get a new one... hopefully the rest of the NFL playoffs and ncaa bball season treats me well. :103631605

I know when we got busted for book making in LA, they took our PC's and fax machines. we were supposed to get them back, but they said something about a court order by the judge. Total BS, they just wanted the PC's.
