A bit off topic, but figured in a forum full of degenerates I might have a shot at someone having experienced this same issue or at least know how one might deal with it.

I live in Maryland, obviously laws vary by state, but feel free to respond even if you know anything about how things work in other states.

Here's the story, they sent me a notice several months ago about suspending my license for accumulating too many points (just in the 8-11 threshold, not enough to revoke it), I mailed my driver's license in and thought no more about it since I didn't have a car to drive anyway and had no real need for it. Well, now I do, so I go to the MVA and they tell me they have no record of receiving my license, asked me if I had sent it via certified mail, well no I didn't send it via certified mail because the form that told me where to mail it said nothing about sending it via certified mail, then they told me that since it had been several months since I sent it in, they couldn't do anything about it, I would have to sign a certified letter stating that I did not have possession of my license and
the 30 day suspension would start today. I thought that was bullshit but I certainly didn't want to wait more than 30 days to get my license back, so I signed the stupid form.

Anyway, am I SOL here? Do I have to wait for the 30 day suspension to take place now that I actually need my license, even though I haven't driven for months? I know they say they have no record of me turning in my license, but they also have no record of me getting pulled over for speeding which was the reason for my suspension in the first place, and given my history that's a pretty damn good indication that I haven't been driving if you ask me.

Any thoughts are appreciated,
Thanks

sounds like you need to be a good driver the next 30 days

Ok, should've seen that comment coming.

Unfortunately there's the issue of registering the car, getting insurance, and all of that stuff, all of which I believe requires a valid driver's license I believe. I'm a gambling man, but in this case I don't think the risk (getting thrown in jail, license suspended even longer, maybe even revoked, etc, etc) is worth the reward (being able to get around for a few weeks). That'd be like laying -3000 chalk on a huge moneyline favorite...yeah, most of the time I'd win a bit, but on the off chance that I do lose, I lose big time.

I would ask them this: had you been pulled over driving with your suspended license any time in the last eight months, would you have been charged with driving with a suspended license, or would they have revoked it on the spot and told you your 30-day suspension starts at that moment? I fail to see why a suspension is only a suspension if you hand your license in.

Sounds to me like they're trying to have it both ways.

But, yeah, you're probably SOL.

Unfortunately logic never seems to work so well with Bureaucracies, but thanks for your thoughts, I might give that a shot but I won't hold my breath.

You have two choices - wait 30 days, get a lawyer to straighten it out.

I'd be taking cabs for 30 days...

Thanks for the thoughts, guys.

I took Sean's advice and sought a lawyer, where I live cab fares would be more expensive than the lawyer, but that's really not an option for me, if I can't get this straigtened out, I'll just be stranded for a month.

I called one law office, and they basically told me I was fucked and there wasn't even anything they could do about it. I emailed another and they emailed back saying that he had to ask me some more questions and couldn't do it over email, so I have to call him tomorrow, will post here with an update after I talk to him, he'll probably tell me I'm fucked too, but it can't hurt to call him.
