Story on why the Law is a bad thing

Here is the story: My father was driving and then stopped at a stop sign or a red light. 2 cars back a deaf/mute 21 year old rear ended the car in front of him totalling it. That car hit my father's car and my father hit the car in front of him. He went to the hospital and got checked out and was okay, the car has some damage to the front and rear end however. This was about 4 days ago

Fast Forward to today: He gets off the phone with the insurance company. The kid who caused all the damage was a deaf/mute and was driving uninsured. Not only that, but the plates he had on his truck were not supposed to be on that truck, but a different car. He also didnt appear in court!

Is there anything we can do or what? I mean, we may have to pay 500 out of our own pocket when my dad is the real victim!

This is why i find it hard to believe in god and i hate the legal system...

if he doesnt have any insurance and claims to not have money to pay your damages you cant really do anything.

you can get a judgement against him ( small claims court I believe) for the damages and medical claims which will follow him around forever and mess up his credit until he pays you. this does not mean he will ever pay you and it will cost a small amount of legal fees to get it. its really all you can do to him

at least in Florida thats the case, same thing happened to my dad he had a car totaled by an uninsured driver

if I were you Id just be thankful your father is OK. cars are pieces of metal, you move on pretty easily. financial problems pass as well.

Mr. Smith: the only way they said they would arrest him is if they pulled him over again.

I am thinking about parking outside of his house, then following him for a street or two and then hitting my brakes and making him rear end me. then the cops show up, and they see he has a warrant out and into the slammer he goes. maybe this would be stooping to his level and maybe it is the several medications im on now that is talking

That's why you carry uninsured motorist insurance. I think I have $400,000 worth. good Luck

Please do not take this wrong but maybe, you should not be on a gambling forum, if you are having financial problems. You maybe better served in giving the dollars you have set aside for gambling to your family.

he couldnt have gotten off scott free, they had to have given him a basketfull of tickets

This doesn't make any sense. Why would they arrest him if they pulled him over again? If this is the case they either could have ticketed him or arrested him in the first place. Why does he have a warrant?

Not always. In Texas this applies to both personal and property damage.

cadillac man, 5 years ago I was run off the road and my car was totaled. My insurance paid for a new car? I don't remember paying a deductable. Thanks

Maybe vary from state to state. In Tx. it's $250.

fill out the accident report. any police reports and the insurance company goes after him. you'll get the 500 at some point but not right away

I'm not a strong believer in our current legal system...

....but how in the world would not having laws make things better?

-Your dad can beat up on a deaf/mute?
-No one required to have insurance, so everyone stuck w/ totalled/damaged cars?


I feel bad for your financial difficulties, (on a side note, gambling forum is the wrong place for financially instable ppl to be) but I hope you aren't blaming your financial troubles on the law? or god? I'll give you bad luck, but anything further is simply denial

1 - It is $500, relax.
2 - This has nothing to do with any legal system. He should have been ticketed for all of his offenses and will have to deal with them. There is no reason to arrest him beyond the tickets involved in the accident.
3 - Your remedy is to sue him, which is well within the confines of the legal system and you should win. Collecting may be the issue. You may also have a claim against the owner of the vehicle. Once you get the judgment you can try to enforce it, typically that is recorded as a judgment against any real property owned by the defendant and some states permit you to attach bank accounts and other assets or garnish wages (perhaps even taking state support funds, which this guy may get by virtue of his disability). I have no idea if your state permits attachment or garnishment.

While there are many problems with the legal system, none of them have anything to do with your problem.
