I'd definitely make a call and get some free ice cream. There shouldn't be metal in your ice cream.

Reminds me of a story... years ago I worked at a pizza place. We get a call about a delivered pizza with a bunch of bolts and screws in it. Everyone thought it was a joke and the manager was leery so he made them bring the pizza in to the store to get a refund. Low and behold, they were right. Something inside the oven broke, a ton of metal fell into the pie, and apparently no one noticed when it was being cut. They got like 5 free pizzas out of it I guess.

You probably should have kept it, and contacted the manufacturer, if you wanted to get anything out of it.

I don't think you have much of a case without a cracked tooth or cut gums or tongue or some kind of actual damages.

Hood or somebody makes it for them and puts their private label on it. They might have gave you something for reporting it to them, sending the metal, etc.

At the store level it dies, and problem may never even get back to the manufacturer for correction of a possible problem.

Someone with a lawyer got a large settlement from McDonalds several years ago for coffee that was "too hot". I don't recall all the details. She may have just been a whore--but you never know these days.

There is way more to that story then just the coffee being too hot. It was a case of pure negligence. The person was actually severly burned because the thermostat was improperly working and they had been warned. Don't always judge a book by the cover.

You will be lacking on damages. To prove negligence, you would need to have damages. i.e cracked tooth, metal lodged in body requiring surgery.
