I got picks by e-mail and sent money via western union. He sent picks, but lied about the service consistently, gave false picks, and denied service for undisclosed reasons...what and how can i take legal action against someone like this? What law is he breaking?

If you sue him you would be throwing money away on a lawyer instead of investing it wisely on someone emailing you plays over a computer.

See if you can sue yourself for being a dumb ass.

You paid for a service.

They provided it.

Think it ends about there. Chalk it up as a lesson learned and move on.

Live by the tout, Die by the tout. This is what happens when you pay for your picks.

No, that's not the problem that he gave me picks and they lost; it's that now he won't answer my phone calls and is denying me service even though I payed for full NBA playoffs and MLB. I will call the NY state attorneys office.

Said many times in this forum and others...

Not wise to pay anyone for picks/information...under any circumstances.

Duty
Breach
Causation
Damages.

If you paid, he has a duty to provide the stated service. The problem will be in proving just what he agreed to provide. Also, what are your damages? These picks are for entertainment purposes only, of course.

I have all the information, in E-Mail about his plays and how he realeses them and the policy.

For example, I jumped aboard, and he gave me Memphis. He then sent an e-mail the next day saying he won on Kansas...he also sent emails from 2 accounts, a hotmail and yahoo. He said the Hotmail wasn't his (which is the one I got the kansas e-mail on) but just recently asked one of my buddies to call, and he personally said BOTH are his. WHat he was doing is false advertising, and giving me the wrong plays for God knows what reason. Maybe he gives half winning and half losing or something i have no idea. But either way, yesterday i got a call that said take Boston -7.5...I saw an e-mail later in a forum that he sent which said Knicks +7.5....He gave me the wrong pick. I had my friend call, and he said he DID give out Knicks, NOT Boston. So I don't know what the deal is.

What I will do is contact the proper authorities and explain the situation I guess and see what I can do. I told him to expect legal action, but he hasn't responded. I actually just called from a restricted number and he answer, then heard it was me and hung up.

You have no basis for a case. You can't prove he had a duty to give you Kansas. Want to see a cool defense he will use? "Memphis was produced by one of my systems, Kansas by another system". THREAD CLOSED. Sorry.

What is this tout's name?

How much did you pay for service?

You said he is denying you service and will not speak with you...and you state that you paid for quite alot of service here...so...

You can call Western Union...try to speak with someone in their fraud department...give them this P.O.S's name and all other info you have on him...address...phone number...etc...explain to them that you paid this individual for his consulting services...and now he is not working with you...is avoiding your calls...and has committed fraud...and he will not refund your money...

You will not get your money back from WU...but they will probably flag his name...and could temporarily mess up his scam-dicapping business...

But the real answer is...Avoid all touts...and never send any tout another dime.

What do you mean? I DO have a case. He's denying me service. He hasn't answered his phone and stopped giving me plays...
