Is this the case?.... I saw it on the Preakness website... has a handful of states where you can not open an account but it is really legal in the rest of the states to gamble online on horses?? is this the carve out rule in effect?? or is this just fluff? im sure this is old news and I must have missed it???

Yes, XpressBet is a legal, U.S.-based, account wagering provider licensed and regulated in several states. Money wagered through XpressBet is co-mingled with track wagering pools.
Individuals must be 21 years of age to open accounts. XpressBet is required by State Racing commission regulations to request your Social Security number to verify your state of residency.
Residents of the following states and territories may not open XpressBet accounts: Alaska, Arizona, Connecticut, Colorado, District of Columbia, Georgia, Hawaii, Maine, Mississippi, Missouri, Nebraska, New Jersey, Nevada, North Carolina, New Mexico, Oklahoma, South Carolina, Texas, Utah, Puerto Rico, Virgin Islands.
Additionally, Pennsylvania residents located within 35 miles of Philadelphia Park, Penn National or Pocono Downs are prohibited from opening XpressBet accounts.
Canadian residents may not open new accounts.

i have been betting with xpressbet,twinspires, youbet,and dayatthetrack for a very long time,all usa based,no problems for me

You did miss it...Horse Race betting has never been illegal and even your mastercard will work just fine...

Haven't used them in a while, but YouBet was very solid for me. But I do remember that getting them money was a pain in the ass. You could use an online check, but had to send them every form of ID under the sun to get started with it,

youbet losing some tracks also no churchill no pimlico

Youbet and Xpressbet are 2 of the easiest places I've ever seen to get money into.
Takes less than 60 seconds.

Youbet is a Publicly traded company on the Nasdaq, I think the ticker is Bet or Ybet.
