WASHINGTON — After a barrage of consumer complaints, the government is banning phone calls of recorded sales messages unless consumers agree to receive the calls.
The Federal Trade Commission also announced that by December all recorded calls must provide an opt-out selection to make it easy for consumers to stop getting those calls. Effective Sept. 1, 2009, sellers and telemarketers may place recorded calls only to consumers who have provided signed and written agreements to receive them.
The FTC said the rules will not affect informational recorded messages, such as messages to notify consumers of appointments and cancellations, because they do not attempt to sell goods or services.
A report by the FTC said there were more than 13,000 consumers comments that objected to the telemarketing industry's request to gain more flexibility to make recorded sales calls.
The agency says the new rules will protect consumers' privacy, much like the Do Not Call Registry. The registry, initiated in 2003, has been widely acclaimed for allowing Americans to eat their dinners without being interrupted by telephone sales pitches. More than 150 million people have listed their phones on the registry, which prohibits calls from telemarketers, with some exceptions.
Mark Cooper, director of research for the Consumer Federation of America, said Wednesday the rule closes a loophole that "was part of the intrusion of unwanted calls."
"Callers did not think they were bound by the Do Not Call list, and now they are," said Cooper. "The FTC finally addressed it."

opt out ... like thats gonna work..

i have pushed 2 on my phone to stop receiving calls from a car warranty place about 25 times.

a voice comes on when i answer saying " this is your final notice " .. ya right , until the next 30 final notices.

How many telemarketing calls does the average person really get in a year? I can't speak for others, but I've had a grand total of about 5 on my cell phone this year. I say 'no thanx' and hang up. I don't need legislation to protect me against that.

I'd bet 90% of that "barage of consumer complaints" were made by people over the age of 65. Old people hate telemarketers with a passion and since old people vote in droves, it's not surprising government officials were was quick to act.

I get 5 a day on my work phone...and I for one am happy that this shit will stop. From extended warrantys to loans for my company it drives me crazy. I also hit the number 2 button and they keep calling

I just received a call this morning telling me to call a number regarding my credit card. The call went on to say I may save money on my VISA, MasterCard or American Express.

What the hell? You mean they are calling me regarding my credit card and they can't even tell me which one I have??? Well I don't have a credit card.

Beware of these calls.

got the same call yesterday...i asked her "which card" is this for?

she said "oh, sir, for all of them"...

I said, "you represent every c/c i have , no matter who its with"?

she said "yes".....

I just laughed and hung up

this is just the same as banning spam, or banning egaming etc etc

if they block 'x' ...someone will figure out how to do it using 'y' method

The difference between spam and these calls is that these companies that are making the calls are in the US and there are laws against robo-calling. If these companies move overseas it will be up to the countries where the calls originate.

Spam is quite inexpensive to send from anywhere in the world. Phone calls are a bit more expensive if being made from foreign countires.

Yea someone calls me,then a recorded voice says please hold.I laugh,and hang up.It needs to be banned.

Spam is quite inexpensive to send from anywhere in the world. Phone calls are a bit more expensive if being made from foreign countires.

yeah but with voice over IP......you simply get service through multiple companies and when you get shutdown in one you take another one. there are literally hundreds of entry points in the US alone (without counting Canada which is of course totally plugged into the US telecom system)

here in CR for instance the goverment telecom is about to engage into VoIP making phone calls to the US dirt cheap (eventually) so with prices of calls coming down.....

take the CAN SPAM act.....did it work? no...you can send fully compliant spam mail and still nothing happens

I am not inthat business so I dont know 1% of it .....but if there is a financial motive (will) there will always be a way.

ok in there I will totally conceed that you have a point, reminds me of course of the strategy with neteller....of course that things can get convoluted with offshore shell corps ....... but we will see
