What advise do you have for someone who is thinking about filing? How much does it cost for the lawyer etc.? What is the process?

My aunt out in Washington filed like 7 years ago.

Paid like 1500 for an attorney.
Credit score instantly drops 200 points.
Good if you want to start over. She filed 11, business failed.
Stays on your record for 10 years.
Don't expect to get a house or credit card for at least 2 years.

I too did it about 12 years ago. Ditto. Best thing ever. Absolutely zero repercussions for me. My advice would be to buy a whole bunch of crap about 6 months before, get those credit cards even higher, then do it.

havent the rules changes a little from 12 years ago ?

not quite as easy to walk away from your debt these days ?

I filed after a divorce in 1985...it is not quite that easy nowadays and I have just as many credit cards has I did then..only difference is that I use them only for travel and pay them right away...was young and stupid then...I maxed one out at a Vegas Casino one night showing off...bad move..but in the end, everything turned out OK...

If he's referring to a 7. You have exemptions you can claim. I think one is 10,000 for furniture. Anything more you get it taken away. 3,000 for a car. If you got equity in your home, like 50,000. Theres ways you can get around that though. My aunt got out of it and didn't have to give them anything.

Think with the bankruptcy she got rid of something like 60,000 of debt. Got a house out in Puget Sound 2 years later after filing.

lets say hypothetically :

60 grand of credit card debt. no other debt.

renting a condo.

no car payment

a few thousand in the bank . make about 45 grand a year.

just walk into an attorney's office , plunk down his fee , file and see ya later credit card debt ???

Yep, plunk down the fee, go to court one day. They ask if you have anything of value. You say no. Done. Free and clear.

florida's got some tough exemption laws. your money should be safe in the bank.

you'll have to give up your car. your personal property exemption is 1,000. if you have more then 1,000 dollars of personal property they'll take everything after 1,000.

what about 2 computers ? 4 tv's ? other items in the home ?

i also heard that if you use a debt consol. place and they work a deal to cut your debt in 1/2 , the IRS can come after you for taxes on the other half . calling it income .

In your situation they'll take your car because its worth more then the exemption.

Your personal property exemption is 1,000. I'm assuming some of those computers and tv's will be going as well unless they are worth combined less then 1k. If your filing with a partner(jointly) though its double, so 2,000 exemption.

BK is worthless. As the owner of a collection agency you can, for the most part, get out of paying most your bills pretty easily.
