WASAGA BEACH, Ont. -- A Wasaga Beach retiree is suing the Ontario Lottery and Gaming Corporation for more than $45 million after he claims he won big on a slot machine only to be offered a few free buffet dinners.
Pawel Kusznirewicz served the OLG with a statement of claim today for a trip to the Georgian Downs slots gone wrong last December.


In the statement, Kusznirewicz states he attended the Innisfil casino with his wife on Dec. 8 and began playing a slot machine called the Buccaneer.
Kusznirewicz played for 20 minutes, gambling about $60, on his last pull, the Buccaneer began to making sounds and flashing its lights, indicating a win.
"The prize won by Kusznirewicz, as shown on the video screen of the Buccaneer slot machine, was $42.9 million," the claim states. All the statements in his claim have yet to be proven in court


Kusznirewicz's lawyer Bryan McPhadden said his client was lured into the casino under the promise of winning a potential dream only to have it turn quickly into a nightmare once he won.


Casino staff told Kusznirewicz he would not be paid the $42.9 million or any amount because the machine had malfunctioned.



Kusznirewicz claims there was no indication the machine was broken and OLG staff couldn't point him to any evidence that it wasn't working. Staff took photos of the machine and then turned it off.



One supervisor gave him a business card for two free meals at the casino's buffet. She then upped it to four meals.



The statement asks the OLG to pay $42.9 million, the prize sum, along with $1 million in general damages, $1 million in aggravated damages, $1 million in punitive or exemplary damages and costs.



An OLG spokesman told the Sun the corporation will have a response later today.

and if it was indeed malfunctioning...how come no offer to give him back the money he put in?the machine was f'ed up according to them right?

I've always thought the same thing Buster

It's not the players' responsibility to worry about whether or not the machine is "legit".

If you win, they should pay, simple as that.

Just my opinion......

And actually they are probably telling the truth here about the 42 Million and that the machine malfunctioned, because I'm sure they had it set, or THOUGHT they had it set, where no such prize anywhere remotely close to that would have EVER won anyhow!

The national lottery has surpassed 42 Million only on a few occasions. So to think the town of Innisfil, which has a population of about 20k (My mom lives there now) would have a machine capable of paying that much is ludicrous.

The Machine is broke. This guy is SOL, if you go to store and a big screen tv comes up as $20 instead of $2000 when it's scanned, the cashier is getting the manager and not giving you a TV for $20

Right now everyone is taking shots at the OLG, they brought it on themselves with a few bad decisions and mistakes.

They printed some scratch tickets with too many grand prizes.

And the ontario auto sector is bashing them for choosing Mercedes cars as a grand prize instead of Canadian built GM's or Chrysler's for a new scratch ticket.

"The Buccaneer is a 2 cent play slot machine with a base game reward of $300 and an absolute maximum pay-out of $9,025, the corporation stated."

If the game has a maximum payout reward of just over $9000 then this guy has no case. Still, I think the casino should give him that $9000 or so just to say sorry for letting the guy think he was set for life. Seems fair.

They offered he refused...dirty lawyer hoping to get them the Million dollars to go away prize...

Wouldn't the machine say the top prize is 42 million somewhere? If it doesn't then he should get the 9K and be grateful for that.

Veronica Castillo, a mortgage loan officer from Beaverton, Oregon, took her mother to the casino in Rochester, Washington, last weekend. She was elated when she put $100 in one of the slot machines and hit the jackpot — or so she thought.

The casino machines all have a sticker on them informing players that a machine malfunction voids all pays and plays, CBS reported.

There have already been a few malfunction cases, and the courts have generally ruled with the casino.

If the maximum jackpot is $20k, and the machine displays $8M --- clearly, that is a computer/electronic malfunction. Not much different than going to the bank, and your account is displayed as $2,030,480 (instead of $2,030.48). Not as though you're going to sue the bank for $2M.

Sucks for the player, but oh well.

"This machine offers a maximum jackpot of $20,000 if a maximum bet is placed on all lines (this information is available to the player on the machine)"
