So I Get A Letter Today Saying I've Overpaid On Child Support....

$900 Too much has been paid somehow.

So.......I call the Florida Service where the funds go through, and inquire about it.

A lady confirms......."Yes sir, we show you have indeed overpaid in the amount of $900"

I ask........."Ok, will it be refunded or credited? How do I go about getting it back?"

She says......"Oh, you will receive it at the expiration date of the case"

I reply......."Do you mean when the child is of age and I don't have to pay anymore is when I will receive it? In 15 Years?!?!

She answers........ "Yes Sir"

So here's the bottom line....

If you GET BEHIND on your child support payments, they garnish your wages or come looking for you.

But.......

If you PAY TOO MUCH on your child support, you have to wait for months, years, or possibly even 2 Decades in some cases in order to get what is rightfully yours back!

LOL

We'll always receive the shaft fellas.....:ohno:

With all due respect Hache you sound a little ignorant. So you overpaid on your child support? Where does that money that you overpaid go? Yeah, it probably goes to support your child. If it went to support the child then you shouldn't care how much you overpaid. Paying money to take care of your child is not a shaft but you're right as a father.

It will come back to you but you shouldn't complain about providing money for your kid.

the usual cost of court ordered child support is far less than what is really needed to provide for a child

With all due respect Hache you sound like a moron. So you overpaid on your child support? Where does that money that you overpaid go? Yeah, it probably goes to support your child. If it went to support the child then you shouldn't care how much you overpaid. Paying money to take care of your child is not a shaft but you're right as a father.

First of all fuego, I'm complaining about the system, not supplying money to my child.

Secondly, you probably should apologize as you don't know anything about my personal life & no idea of the story & how much I already currently pay.

They actually even made a mistake on the final paperwork from what the judge ordered, to the tune of $200 too much per month that what was supposed to be.

That was 1.5 years ago, and I have left as is when I could have had it lowered, and still can but choose not to.

Once again, the system is a complete joke.

I have called these places in the past to try & make payments faster & easier for my ex, only to get recordings & no calls back until 1-2 weeks later.

For something so important as child support in which they like to stick it to guys who do not pay, they are very unprofessional about the way it is all handled, even for those responsible enough......

You're right, I don't know (or want to know) anything about your personal life but you're bringing it on the forum so now I know more than I need to know. You can argue that you're complaining about the system but the way you worded it does not indicate that fact.

Why not just work out a private payment without the courts with your EX? Would that be workable?

You have to do whatever they say or order.
It was ordered to go through that system, and we have no say so in those cases.

As for her, let's just say she's as sweet as can be because she knows she is getting the extra dough every month from the mistake in the paperwok from what the judge ordered that I could pull the plug on any time if I wanted.....haha

They are the ones who sent ME the letter saying the money was overpaid.

The point is.......why, if you cannot collect it...........LOL

most men dont realize that if your ex is ok with it...you can work out child support agreement amongst yourselves

from support to custody arrangement...

most women wont but it is possible

ex took me back to court for 6 cost of living increases and was no contest as judge would not even let me talk; talked to lawyer I know he said I could hire him but would lose and have to pay him and wife's lawyer both. when my son became 21 and out of school asked about not paying any more and they said I would have to get lawyer and go back to court to get order to stop payments. this took about 4 months and 1600.00 more dollars but through with this now.

Not necessarily if you didn't go to court in the first place. My folks worked out a private plan between themselves and never went to court. My dad paid the money every month. You guys could also (if I'm not mistaken) go back to ammend the original order if both parties agree.

Well, there is more to the story...

We both had lawyers.

I finally convinced her we were both just throwing money away as it was dragging on for months, and we were able to drop our lawyers & continue ourselves in front of the judge.

When we had attorneys, they do all of the figures based on the funds both of us brought in & other things.

At the time, I was working full time & getting lots of overtime.

She was only working part time.

So, since she wasnt working, combined with my getting lots of overtime, it jacked the Payments way up.

Well, she finally started going back to work full time, for months.

She actually agreed to lower the payments by about $200 per month, because she knew how it worked & that we could have it refigured & it would now drop the payments drastically since she worked full time, AND.....I stopped getting overtime at my job.

So, in front of the judge, we both gave our agreements.

The judge agreed & Lowered the monthly payments by $200.

When all was said & done & we received he final paperwork a few weeks later, not only was there a mistake in the paperwork that the monthly payments weren't reduced by $200 as the judge ordered, but it was actually INCREASED $200 MORE!

That's a $400 swing!

Like I said, that was 1.5 years ago, and I haven't done anything to overturn it, even though I could.

The $900 I received from the letter has nothing to do with this mistake, as the overpayment of that amount was from in the very beginning somewhow.

My whole point was, why send a letter stating you have overpaid by a certain amount, and then turn around and tell you "ah, well, you can't collect it anyhow"...lol....It's just kind of funny & ridiculous

There are transcripts from all court proceedings. Why not go back to court?

She knows it too is the funny part and even though she doesn't try to cause any problems anyhow, she is EXTRA nice while she's getting that extra money!
