Why didn't Plax just plead guilty?

Just curious as to how he beats the rap, unless there is a die hard Gman fan on the jury.

I have not followed the case that closely, was wondering if there was no plea offered?

NEW YORK (AP) — Former New York Giants wide receiver Plaxico Burress (FSY) testified Wednesday before the grand jury that is investigating weapons charges against him and told reporters outside that he was sorry for his actions.
"I was truthful, I was honest, and I'm truly remorseful for what I've done and for what happened," Burress said outside a Manhattan courthouse.

Burress' attorney, Benjamin Brafman, said the one-time Super Bowl star wanted to address the grand jury.

"I agreed that in order to humanize him they needed to see who he was and what this man was about," Brafman said.

The 31-year-old Burress shot himself in the thigh at a Manhattan nightclub in November. He was charged with weapon possession and faces up to 3½ years in prison. He has pleaded not guilty and is free on $100,000 bail. The Giants released him in April.

You got a point here. I have no idea how he could be found 'not guilty'. Unless the entire jury are die hard Giants fans.

Going to trial and losing is going to suck ass.

Unless one or more jurors nullifies the mitigating facts of the case, he'll be convicted.

The reason he would plead not guilty at this point is to try and exercise some leverage and motivate the prosecutor to offer a more preferable plea bargain in exchange for avoiding the time and cost of a trial.

Less than 10% of all criminal cases actually go to trial. The rest are pled out through a variety of different agreements between the prosecutor and the defendants.

I have a feeling that if the jury were to really see what this man is about they would throw the book at him. As a Giants fan I loved his talent on the field, but he sure does seem to have some major flaws as an individual off the field.

First off, you need to understand that in law there is NO black and white. Everything is a gray area open to negotiating between the defendant's lawyer and the DA. I once got busted for driving with a suspended license because I didn't pay a speeding ticket. Open and shut case right? Nope. I showed up to traffic court, pleaded some random case about how I was interviewing at a lot of places and still had a home where I went to school along with my parental's place where my license was registered to, and I reasonably missed the mandatory suspension notice in the mail blah blah blah.

Long story short, the judge didn't even want to hear it and just gave me citation for driving without my license ON ME vs. the much worse driving with a license SUSPENDED.




For Plex, the penalty is mandatory 2 years in jail. You can't just cop to that. That would be insane, and pointless.

This is slightly OT, but as a Giants fan I am really going to miss seeing Plax on the field.

He did so much for that O. With his speed, size and hands it really opened up the field for the G-men offense. They were uncongested and could try all kinds of plays.

You should never bank on a WR to be a good team. But a good WR is key to being a GREAT team.
