breaking news on cnbc just now...feds stepped in and said its unlawful....throws a wrench in things...i wouldnt expect anything week 1 nfl....i predict years of legal battling :ohno:

PHILADELPHIA – A federal appeals court has ruled that a plan to offer sports betting in Delaware would violate a federal ban.
The plan was opposed by the professional sports leagues and the NCAA.
The ruling came Monday after a three-judge panel in Philadelphia heard almost two hours of arguments from attorneys for the state and for the leagues.
Delaware claims it is exempt from a federal ban on sports betting because it ran a sports lottery in 1976. But the leagues argued that the exemption does not allow Delaware to offer bets on single games or on sports other than professional football.

This sucks!! I was looking forward to driving over a few weekends. Many of the tracks over there spent a ton of $$$ in anticipation of this. The State was relying on this revenue.....

This was a BS ruling. The NFL has so much power in this country. Apparently more power than the state of Delaware.

Delaware was supposed to be 1 of 4 states that could allow sports gambling. If they say it can't be done in Delaware then they have to shut it down in Las Vegas. Delaware will win this in the end but it will cost them millions extra and the businesses that fronted the money to start setting up for sept. 1 are out big.

This is a bad ruling but you guys are right. The all mighty all powerful NFL has put a major wrench into Delaware's plans. Of course this will get appealed but time is money and who knows how long this will take to get resolved. Without betting the ratings go way down, especially on games between two 1-5 teams.

The NFL, the other major pro sports leagues, and the NCAA headed to Philly today for a hearing before the United States Court of Appeals for the Third Circuit regarding the question of whether Delaware's plan to allow sports betting should be stayed until the litigation challenging the move could be resolved.

Instead, the federal appeals court scuttled all single-game betting.

Per published reports, the court found that the new Delaware plan would violate the 1992 federal law prohibiting any sports betting, with an exemption available to states that employed sports wagering from 1976 to 1990.

Apparently, the court prohibited only the attempt to legalize single-game betting, which was not part of the Delaware plan in 1976. The NFL has argued that Delaware should be allowed at most under the federal law to allow multiple-game wagers on pro football games, since that's the specific program the state previously used.

The maneuver is unusual. The appeals court skipped over the question of whether the betting would be stayed pending resolution of the litigation -- and then resolved one of the most important pieces of the litigation against Delaware.

The NFL separately is challenging whether the multi-game betting program violates the Delaware Constitution.

If sports betting is already legal in Nevada how could making it legal in Delaware jeopardize the integrety of the game? Makes no sense to me. Now if it was not legal in Nevada and Delaware was trying to become the first state to legalize sports betting I could understand it but this makes no sense to me? Hasn't Delaware already contracted a firm to run the betting service and done major renovations to the race tracks?

my guess is that it's a bit more complicated than what's been reported so far. yes, the '92 law allowed sports betting in those states where it was already taking place or was authorized. What Delaware APPARENTLY had in law at that time was an allowance for parley betting or something similar, not betting on individual games. In other words, betting on individual games was not authorized, so the court feels doing so now would go beyond what was allowed by the 92 law.

WHAT REALLY NEEDS TO HAPPEN IS FOR THE 92 LAW TO BE REPEALED OR FOUND UNCONSTITUTIONAL IN COURT. The court effort is underway, but it may take years to conclude.

The NFL fixed this just like last year's Pitt-San Diego game. No doubt some money changed hands here.

Horrible, horrible result.

I'm really shocked, thought this was a go for sure as they were exempt from the 92 law, like Nevada.

shocked....didn't Dover spend around 5 million on their sportsbook... Everyone here (NJ) was getting real excited about this...wow
