Unless your talking about a union or government job (teacher,etc) then its up to the private buisness itself to set any rehire standards. There is no law covering this as it pertains to private buisness...yet....that i know of.

For instance i knew 2 brothers who both worked in a plant here. Both failed drug tests. The private company that owns the plant booted #1 brother that day no questions asked and no re-hire status. Brother #2 worked for a union contractor inside the plant, was sent to rehab and was eligible for rehire 6 months or so after completing the rehab.....

Drugs are usually the grey area in most.
Theft, intentionally harming the buisness, walking off the job without notice. etc are usually the standard grounds for non re hire status...

Exactly right. Each company is different. And it's usually very subjective--you do something like check a box on a form "rehire, yes or no". A lot of times it just depends on whether or not I like the guy. Unless he did something that is absolutely non-rehirable.

Some companies will get a bonus (tax breaks) for hiring a convicted felon so you might be in luck.

haha if only i were. nothing too serious i'll actually post it in here.

Here's the situation:

Put my two weeks notice in (actually put 15 days notice in). Was EXTREMELY sick with the Flu on my last day and a hernia that developed, and called in sick THE NIGHT BEFORE for my last day. Called in the next day and apologized saying id come in an extra day to make up for it but they said dont worry about it. Now my manager is trying to put me down as a non rehire!

I am reviewing the employee guidebook right now, and the only thing it says is that you have to give two weeks to be eligable as a rehire...I think i can beat this, ill speak to my manager tomorrow..any thoughts?

I use to run a corporate grocery store...and when someone quit, got canned or left for a new job we would have to fill out paperwork when they left and we had to check if they we would hire them back or not...if we put no re hire then we would have to put a reason why...the only way i know of getting a no rehire overturned is to talk to hr and then to your manager to explain the situation..otherwise your shit out of luck from my experience....thats why i always tell people not to burn bridges.

Only one person completes that paperwork and if they were pissed at you when they did the paperwork it is what it is. It is unfortunate that many people feel they are "getting in one last shot" when they do this.

Suggestion moving forward. For this position use as a reference someone that you worked with that you worked with for as decent frame and you reported to them. Stay away from co-workers, etc go with a supervisor. Get and have their phone number/email and periodically stay in touch with them.

Still fuming over this, will talk to the manager tomorrow and see what the deal is. Also must add that I spoke to a different supervisor and offered to come in to make it up, but she said don't worry about it..

so from what i get you quit this job gave a notice and now you are trying to go back to this job? i mean if you were a good employee and werent an ass then i dont think there should be a reason why they wouldnt let you come back....keep us posted on what happens and good luck

No, I quit this job to pursue a different job path, and with the upcoming interviews i want to put this on my resume cause it is high quality. I think it will work out, I'll know tomorrow for sure.

You were looking for a job when you found that one. So don't worry about it if your worth you weight then you don't need a stinking reference. Plus most companies these days just say yes you worked there due to law suits.

If it means that much to you, contact the HR person and let them know that you did give a notice and work it out, etc and that what is indicated moving forward has meaning to you. It has more meaning to you than them and basically if you did leave on at least okay terms they should be professional enough to give a recommendation rather than use the process as a "parting shot" (which is what they are doing)

How long did you work there? I have a similar instance in my background where I worked for someone for seven years and don't have a good reference (new manager came in, etc) ~ most people "get that" and see I worked there for seven years which outweighs any "bad reference" they could possibly give.

UPDATE:

What a FUCKING hassle that was! Talked to dept. Manager today and he told me that this was non-negotiable, I was fuming...

Went to the Pres/CEO of the company and talked to him....wouldn't you know it, i am now REHIRE status.

Unreal how the guy tried to low blow me....I made sure to note it in the HR report

I have to be able to use this place on my resume because it is a place of very high standing and would look great for me. By being in Non Rehire status i wouldn't be able to put it on my resume--now i can, even tho the asshole tried to take one last shot at me before i left.

Sure they'll offer to rehire you but they will offer you a shite salary so you won't take it.

The CEO was very prudent.

I have friends who have worked in HR for larger companies and they've told me that it's policy to NEVER answer the question, "Would you rehire this person?".

Either answer can expose them to potential labor-related lawsuits.

Best for them to just confirm dates of employment.
