Can you get in trouble for someone'e else picks?

If a tipster runs a registered business and if one of their clients buys the picks from them and sells it for more, can the original tipster sue them for selling the tips by copying and pasting the email? There is a huge debate where some guy bought the picks from bettingresource and sold it for twice as much for almost 2 months. Bettingresource picks were doing so well during this time that most people paid this guy twice the cost because they didn't know about the source of the picks, but eventually the guy got exposed and never came back to explain. But some guys in the forum said that bettingresource can get all the profit that the second seller gained and more buy suing, but i don't think this will stand a chance in court. I mean, there is only two sides to each game and you cannot copyright a side! Only chance is if they had long analysis and if the seller copied everything word to word!
