Help,help need advise!!

We purchased a liftchair wed. nov.25th for my wife[56yrs old] who suffers from adult scoliosis & other health issues & spends her 24hrs a day in a recliner as she cannot lay flat in a bed.She is able to walk w cane/walker [she is bent over at the waist] at a very slow pace but other than that she spends her time in the recliner.

The liftchair made of leatherette has caused her butt to become very sore as there seems to be a hard spot under the cushion where she sits. We called the salesman/owner 5 days after the purchase [due to holiday weekend] who came to the house to sell us the chair & told him of her problem & he told us to go purchase a memory foam cushion to give her more padding, so I went & got a 5 inch memory foam pillow & added another pillow on top of that & now she is sitting almost even with the armrests almost to the point of falling off the chair & is very uncomfortable & in more pain than when we purchased the lift chair.

When we purchased the chair, he agreed not to run the charge until after Dec. 5th due to a 1.99% promotion rate on our cc, but asked me for a check for $1300 that he would hold until charge was put through. Well after getting the pillow as he told us to do & saw that wasn't doing my wife any good, I called him at the store & the receptionist/secy said that he was out or busy. Well after about 2-3 attempts to reach him & after he's not calling me back as the secy said he would. I told her not to run the charge[now Dec.7th] & to come and get the chair & she went on to say that the salesman/owner said that he told us that there are no returns. This never was mentioned at anytime to us during his presentation to us.

I then called my bank & put a stop payment on the $1300 check & called the CC company who said it had not been posted at this time & notified them of what was going on & they went on to say, to dispute the charge if it comes through. I told the secy at about 12 noon not to put the charge through & found out later that day it was put through at 2:16PM about 2 hrs after i told her not. I then called the store & secy said the salesman/owner said to run the charge through. We called the cc company & disputed the charge as defective merchandise, they sent a letter to the merchant notifying him of the disputed charge.

This is now Dec 17th! We disputed the charge Dec. 7th. The store will not come & pick up the chair. OH ALMOST FORGOT, THE LIFTCHAIR WAS A FLOOR MODEL & he would not give us a discount. (He had us over a barell as the old chairs reclining handle broke & my wife had no chair to sit/sleep in & he knew that.) I have since researched this chair online & it sells for around $800 at several places.

I hope you can understand this garble or whatever you want to call it but excuse me as I am 71yrs old & trying to take care of my wife the best I can & am not that educated when it comes to English language.

HELP, What should can I do. Will he sue us in small claims court as the chair is just sitting here & he has not received any money as the cc company gave us a temporary credit on the acct for the chair, & he will not pick up the chair.

Please HELP & THANK YOU.

My best advice is to force the credit card company not to put the charge through, they may advise you that you need to dispute it with the company, but you can push them not to allow it to go through, especially if you have been with them for a while.

If the credit card company refuses to help you the only other thing you will really be able to do is to sue this company through small claims court.

Do you have any documentation outlining a money back guarantee?

ok...this is what i would do...

1. Hopefully u kept some type of records of the events that were taking place (butt sore....bought extra pillows...etc)

2. Take your rump down to the store and talk to this clown.

3. How long have you owned this chair. Don't they have a money back guarantee or return policy on this. Maybe a 30 day , which is typical. If not, might should have checked that beforehand.

4. Call your cc company and keep them advised as to what is going on.

SportSavant,I am sorry for the way i tried to explain my problem, that is why i don't post much on forums,but only completed 5th grade as i ran numbers to feed my sisters & an ill mother as we lost our father at a very young age, i apologize again,sorry.

first off i would never tell a seller your in a pinch or a bind, this will just make them greedy and try to take advantage of you if they can.

go down and talk to the person in public, if they continue to fight you, you could maybe even try to talk to your local media... They love to do stories on compaies trying to screw over an older couple (espically one with medical issues trying to do good).

SportSavant,Discover cc gave us a $1300 credit[after the $1300 charge was posted] on the acct after we disputed the charge as defective merchandise.
I see nothing about a money back guarantee, matter of fact, the secy said that the owner told her to tell us that he told us there was no returns during his presentation to us. This was never mentioned other than the warranty from the mfgr.

Where are you located at?

I used to work for a company that sold liftchairs. They have offices in a few states.

Name the company maybe we can call and get after this place to do the right thing. I fucking hate people that do this type of shit. Name names and we can get after him.

It will be very difficult for you to take action because they will claim that you gave them the account number and it wasn not illegally obtained.

You are in a very difficult position, that is I why any time anyone asks for a bank account number via for a posted dated check, you never give it to them.

Had a similiar issue many years ago with a furniture company. Find out where their corporate offices are and put a call through to them. If that doesn't work, call your local TV channel. Call the better business bureau as well. Would love to help you out. If you would like to pm me the information I will see what I can find out for you.

Lori is right, call your local TV station and have them take the story, trust your problem will be solved, better than court.

elegance collection model#LL585, it is a leatherette chair, i am located in w.va.
SportSavant, No, the merchant has no money from me or the cc company as the cc company gave us a temporary credit on our acct due to us disputing the charge as defective merchandise, the cc company said they will make a decision within 30 days, i also stopped payment on the $1300 check which the merchant sent back to me with a deposit only stamped on the back of the check.

Pressure the credit card company to not honor the charge and then you will be fine, they have no money of yours.

they will have to come and pick up the equipment.

Don't let the credit card company off the hook, if they say you have to dispute the charge with the merchant, remind them how long you have been a customer, and tell them that you used the credit card because you expected to be protected.

bigtendominator, I never claimed that the cc acct.number was illegally obtained,i disputed the charge as defective merchadise & asked that the cc company not put the charge through, I also DID NOT give them apostdatedcheck, i dated the check the same day he was here, but put a stop payment on the check before it was put through to my bank. The merchant has sent me the check back with a deposit only stamped on the back, i believe he may have stampedit in case it got lost & then no one could cash it,that is my belief.Thanks for your respnse

What would happen if we closed the cc? Also can he bring suit against us in small claims court & if so does he have to bring suit in my city/county or can he do it in the neighboring city/county where he is located?
