nothing serious, but would like some input.

so i'm driving down the highway today and I end up getting a blowout...on a 4 lane highway, i'm all the way in the left hand lane. so I put my hazards on slow down and try to pull over but theres a ton of traffic meanwhile these cars are going about 60-70 and im going slower and slower, theres a u turn right to the left of me thats not supposed to be used by the public, police sit there to radar and u-turn themselves . There was no on coming traffic on the opposite side of the highway so instead of trying to cut across 4 lanes with loads off traffic behind me I used the u turn than pulled over. Well there was a police officer in the area who saw and pulled behind me. long story short he saw the flat and saw me make the "illegal" u turn and ticketed me for it. I tried explaining to him that it was the safer decision but he still proceeded to give me the ticket. does anyone know what type of fine this is or any points? He used a pencil I believe and I cannot make out anything he wrote on the ticket except that I am required to go to court. Still really can't believe he gave me the ticket. To make matters worse, after he summonsed me he said a tow truck would be in route and got in his car and drove off, leaving me there. I waited about 2 hours and no1 ever came, I was forced to drive on the flat to the nearest exit and leave my car in a parking lot, probably screwing the alignment up. (if i left it on the side of the road on the highway and a cop saw I would have been hit with a huge fine). Do you guys think I can get this dropped? I don't see why an illegal u turn ticket is required a court appearance so I must be missing something here...

forgot to mention that I did not have a spare..

Actually a court appearance is not required unless you wish to contest the citation.

If you're willing to concede guilt or plead NoContest (both options are likely available on the back of the citation form), you can simply follow the instructions and mail in the appropriate fine* on or before the court date on the front of the ticket.

plead not guilty and explain what happened. I think it gets dropped.

Definitely go to court ans make damn sure the 1st thing u tell the Judge is this "public servant" left u stranded on the side of the road for 2 hours......id make it 3 and add a couple of toddlers in the backseat....Then tell him you made an emergency judgement call which obviously was the right call since u did it withour causing an accident in an emergency situation....

All this may get u nowhere but the cop will have to show up for court on his day off and that alone is worth it....I probably couldnt resist a "nice to see you A-Hole" comment as well but thats not recommended

Just fight it and you will have it dropped. The DA won't let it go to court ask for a jury and they will drop it due to cost. Officer need to make his quota for the day and seen a easy stop.

Chances are the cop won't show up and it will get dropped. If you do goto court and so does the cop; how are you gonna prove you had a flat and that was your reason for being in the U turn area?

He won't show up on his day off, he gets overtime for it. At least that is what a cop told me for "parking in a dust free lot" when my car overheated. I asked him if he got paid for going to court and he said he got overtime.

Keep in mind that this is a cop and cops more than anyone else are more likely to lie.

Definitely take a shot in court. Be sure to bring a receipt for fixing the flat tire or purchase of a new one. Take a picture of it too if it has been replaced instead of repaired. Also photos of the scene showing the danger of crossing 4 lanes and safety of the manuever you made.

Don´t mention the lack of a spare to the judge if you can avoid it. GHood luck and post how it turns out.

go to court and explain the situation. The judge will more than likely drop it based on what you are saying. If the cop shows up and says what flat tire, respond by saying why did you "call me" a tow truck. You will get out of this with 30 bux court cost.

Rather, all their citations are scheduled for same Appearance date and they only come in if someone asks to contest the citation(s). In that case, they're paid Overtime rate, so you can be sure they're more than happy to come see you face to face.

As a lawyer in South Florida whose father used to be a traffic court Judge in Miami for many years you need to go to court and explain the situation to the judge. This was an emergency that you were dealing with and you were considering the public safety when you made the decision to make the u-turn since there was no traffic going the other way and you were on the left side of the road. This seems like a no brainer to me.

If the ticket says court appearance is required then it means that you have to go to court. That is how it is in NJ. I'm assuming this happened on GSP,287, or 80. Why didn't you call a tow truck yourself rather then wait the 2 hours and drive on the bum tire?

Actually this is the best advice, i was just as pissed off as you were when i read your story....

I'm sure each agency does things differently. In Houston, when you go to court as an officer depends on when you are scheduled to work. For the most part though, attending court is OT and most officers will attend. Our department is very strict on court attendance and will discipline officers for missing a court appearance.

Now, to the subject at hand. Going strictly by the story presented here, I would myself fight this ticket. Any judge or DA with any sense at all would agree that in the situation you presented you did what was safe for both yourself and other drivers.

I can't and won't comment on the officers actions because I wasn't there.

Lastly, I always get a chuckle out of these types of threads and some of the responses, especially the "quota" types. Here in Houston, the officers are not required to write any set amount of tickets. If you don't want to write any then you don't write any. Usually, in most cases, the officers with the radar and such are traffic officers and their only job is to write tickets.

I would plead not guilty, and when you arrive in court for your appearance make sure you bring receipts showing whatever repairs you had done for your vehicle.

It really depends on how much the fine is and if any increase in insurance rates there are. I read that a speeding ticket costs over $1,000 in increased insurance rates so if that were true it would be well worth my time to spend an hour in court and even attorney fees (if reasonable) to fight a speeding ticket.

If the fine + an increase in insurance rates were the case with the original poster's situation it would be well worth it to show up in court. Some people may be willing to show up in court just as a matter of principle, not even considering the small fine if it were indeed small.
