I believe that in order for you to be able to take legal action there has to be some sort of "damages".
I'm sure there's some obscure law on the books somewhere that you can sue them under. If you do sue, they'll ask for a motion of summary judgment in their favor. If they don't get it, based on the cost of defending, you'll probably get a few bucks in a quick settlement.
