To make a long story short as possible, I have a good friend who I have known for over 10+ years. He is married with 3 kids and his wife and him are being harassed by a security guard at their apt complex. They live in a very rural area and it is border line hick town. The security guard spit in their face pushed them and has even pulled a gun on them in front of their kids. A police report was filed, a restraining order was placed and now they have an eviction notice. I gave my friend my attorneys phone number and said to call him I will cover the costs. But my attorney said there is close to 50 pending lawsuits against the apt complex and security company, his exact words to me were "How much money do you want to put in this situation, judging by the history this could be a while" big company owns the complex lots of money. My friends 1st response was to take care of it the old fashion way, but he trying his best to take proper legal action and leave violence out of it, but it is getting to that point where he is running out of options.

-this has all taken place since early jan 2010
-everyone involved is white, so non racial issues
-police came out a few times and said next time they are going to charge him for a non emergency call
-police officers know the security guard
- his kids are all under the age of 6

Move...its not worth the trouble to stay where ur not wanted.
Kinda weird advice from the atty, seems like if its a big company that would make it more worth suing...so i assume he doesnt have much of a case...May try another lawyer i guess..

I think thats what he is going to end up doing. Told him yesterday its not worth the trouble or the headache. But he is stubborn and not going down without a fight. I know he spent some money and time moving there but sure it will cheaper to spend the money again and move away than trying to fight this
I agree with the set up of video camera to nail the guy and have solid proof.

Has anyone gone to the media? If not it's past time to do so. Get one of those 4 on your side kind of reporters involved and things will change quick.

Seems to me like your friend is leaving something out of the story. If your friend did not provoke this man than his kids and wife should be gone to a relatives or friends house already. No way a guy pulls a gun on me and my kids go anywhere near there again.
Your friend has already had a gun pulled on him, been spit in the face, and gotten his cell smashed? If your friend hasn't retaliated yet, than he prob isn't the type. Just get his family out now and your friend can take a few days to get everything out himself.

Thanks for the idea, was hoping someone could come up with something creative. I feel bad for the guy he is just one of those that always seems to never get a break. If a baseball was hit into a crowd of people it would hit him in the face. In to a parking lot, it hits his cars windshield.
As much as I told him he needs to just leave asap he is tired of getting pushed around and he moved out there for the low cost. He is a bigger overweight guy and his wife is very good looking. Thats really how the whole thing started was the security guard made comments about them for a few days and when he asked him to stop things escalated from there.
I am going to tell him to contact the news papers in his town.

did he talk to the owner ?
did he talk to the president of the association , assuming there is one ?
why is security company still on the job if they are a threat to the tenants ?
if a restraining order is in place , the guy cant come within how may feet of him or his family ?
i've never heard of a security guy running an entire complex .

Its more of a ridiculous situation, I had a hard time believing it when he called me and even had an attitude of "why are you bugging me with this". We try to meet for lunch once a month just to stay in touch and when we did I seen the look on his face of just mentally beat down and fed up. That look just bothered me, I know he is a good guy and means well. He really has turned his life around so wanted him to stay on track so I got involved. The responses and run around I have been getting from the apt complex has been shocking. I called corporate have yet to hear anything, even had my lawyer fax the police report but nothing.
If the security guard would let them be then they would just move
The only details left of is slashed tires, paint & poop thrown on their front door, windows being broken, stuff like that.

Sounds like the guard has made many different enemies. If some thugs from a different area rough him up in a dark alley and the guy gets his knee bent the wrong way, the cops wouldn't know where to start
